Executive Summary (General Business): The applicant is requesting a Special Exception Use (SEU) to permit 10,350 square feet of enclosed assembly recreational space without an alcoholic beverage license for on-premises consumption of alcoholic beverages.

Staff Recommendation: Move that the Council approve the resolution as recommended by the Planning and Zoning Board.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and approve the resolution.

2.                     Move that the Council deny the resolution and provide staff with direction.

 

Background: The proposed use is a private school with a baseball training facility. The applicant is requesting a Special Exception Use (SEU) approval for the recreational component of the project. The applicant proposes to occupy space within an existing building on the developed site with interior modifications to accommodate the training functions. No exterior site changes are proposed. The overall operation consists of two functions; a daytime academic program and an indoor recreational facility that operates during evenings and weekends. This separation in hours of operation eliminates any overlap in parking demand.

 

The SEU request applies only to the recreational component. Under the City’s Zoning Code, the Service Commercial (CS) Zoning District requires Special Exception Use approval for enclosed assembly areas exceeding 3,000 square feet. The proposed recreational facility exceeds this threshold, triggering the requirement for SEU approval.

 

Issues/Analysis: Special exceptions are uses that would only be allowed under certain conditions and are reviewed for compatibility with the existing neighborhood. Approval of a special exception application shall only be granted by the City Council if it meets the criteria established under Section 158.260 (A) through (L) of the City Code.  The applicant’s responses to the criteria and the staff’s findings are detailed in the staff report. Due to recent legislation, the school use no longer requires Special Exception Use approval and is now permitted by right within the zoning district.
