Summary Brief (Agreements/Contracts only)

1.                     Prepared by: Office of the City Attorney.                     

2.                     Parties: City of Port St. Lucie and Veranda Community Development District II “District”.

3.                     Purpose: To authorize the District to maintain certain maintenance responsibilities for portions of SW Becker Road and the roundabout at the intersection of SE Becker Road and NW Gilson Road.

4.                     New/Renewal/Modified: New

5.                     Duration: Indefinite

6.                     Benefits to Port St. Lucie: The agreement will allow the District to exercise its special powers to provide infrastructure, public improvements and community facilities and services for the benefit of the District Lands within its boundaries.

7.                     Cost to Port St. Lucie (Annual and Potential): There will be no cost to the City.

 

Presentation Information: Staff will be available for questions.

 

Staff Recommendation: Move that the Council approve the resolution authorizing the Mayor to enter into a maintenance agreement between the District and the City of Port St. Lucie for a portion of SW Becker Road and roundabout.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and approve the resolution.

2.                     Move that the Council not approve the resolution and provide staff direction.

 

Background: According to the Development Agreement, Veranda Development re-constructed and landscaped a segment of Becker Road from SE Via Tesoro to Gilson Road. The developer has installed landscaping and decorative hardscape that is above and beyond the minimum requirements of the City. The developer also desires a higher level of maintenance than what the City typically funds. This agreement will remove the responsibility of the City to maintain the enhanced landscaping and hardscape, and put the maintenance responsibility on the Veranda Community Development District II.  In addition, the District and the City also desire to clarify the relationship between the District and the City with regard to certain landscaping north of the Becker Road right of way irrigated by the City’s irrigation system.

 

 

Issues/Analysis: The resolution authorizes the Mayor to enter into a maintenance agreement between the District and the City. 

                     

Financial Information: There will be no cost to the City.  The District assumes all costs associated with the landscape, hardscape and irrigation of the area except for certain significant repairs to City property that are not caused by the District.

 

Special Consideration: Execution of the maintenance agreement is necessary for the District to assume the responsibilities of maintaining a portion of SW Becker Rd and the roundabout at the intersection of NW Gilson Road.

 

Location of Project: SW Becker Road to NW Gilson Road.
