3.                     Purpose: To assist the City in meeting wastewater treatment standards mandated by the Florida Department of Environmental Protection (FDEP).

5.                     Duration: Contract Expiration remains on October 11, 2026.

6.                     Benefits to Port St. Lucie: Reducing nitrogen and phosphorus from effluent water, through high quality treatment, will result in a reduced growth of algae, improved water quality in general, and will reduce any negative effects on the St. Lucie River.

7.                     Cost to Port St. Lucie (Annual and Potential): An additional $279,903.75 for a new Contract amount of $7,127,342.60.

Staff Recommendation: Move that the Council approve Amendment #11 to Contract #20170132 for Design Services for the Westport Wastewater Treatment Plant Expansion with CHA Consulting, Inc. fka Reiss Engineering, Inc.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and approve Amendment #11 to Contract #20170132.

2.                     Move that the Council not approve Amendment #11 to Contract #20170132 and provide staff with direction.

 

Background: The Westport Wastewater Treatment Facility is permitted to treat up to 6.0 million gallons per day (MGD) of wastewater using biological processes that meet secondary treatment standards of 20 mg/L for both Biochemical Oxygen Demand (BOD) and Total Suspended Solids (TSS), with no current limits for Total Nitrogen (TN) or Phosphorus (P).

 

However, new nutrient regulations from FDEP require enhanced treatment to achieve effluent limits of 10 mg/L TN and 3 mg/L P. In response, the City engaged CHA Consulting, Inc. fka Reiss Engineering, Inc. to design system upgrades and prepare construction plans the meet these new standards.

 

Following the initial design phase, FDEP awarded the City of Port St. Lucie Utility Systems Department a $15 million Grant to further reduce nutrient levels to 3 mg/L TN and 1 mg/L P. This Amendment will support CHA Consulting, Inc. fka Reiss Engineering, Inc. in completing the expanded design and assisting with implementation of the additional treatment requirements.

 

These stricter nutrient limits fall under Advanced Wastewater Treatment (AWT) standards, which are expected to become mandatory for municipalities statewide. The FDEP Grant positions the City as a leader in proactively meeting future regulatory requirements.

 

Issues/Analysis: City Code of Ordinances, Section 35.09(b), grants the City Manager the authority to approve increases to contracts previously approved by Council (1) up to 25% of the original contract price or (2) $99,999.99, whichever is less, for non-construction contracts. Since Amendment #11 exceeds the City Manager’s threshold in Section 35.09(b), staff is requesting Council approve the Amendment. Staff has reviewed the Amendment and finds it to be fair and reasonable.

                     

Financial Information: Funds are appropriated in Utility CIP Fund / Westport WWTP / Design / Westport Expansion. (#448-3512-563004-Y1728).
