Executive Summary (General Business): Mattamy Palm Beach, LLC, (Developer) has submitted an agreement for the conveyance of park sites to the City for the Western Grove DRI.  The conveyance agreement is required by Conditions 63 of the Western Grove DRI to address the demand for parks created by the project in accordance with the City’s level of service standards for Park and Recreation Facilities.

Staff Recommendation: Move that the Council approve the agreement.

Background: Condition 63 of the Western Groves DRI requires the developer to prepare a plan to be approved by the City for the provision of neighborhood and community recreational sites and facilities.  The plan has to identify that Western Groves is required to provide the City with 50 acres of net usable park acreage to meet the City’s level of service requirement of 5 acres of parks and recreational facilities per 1,000 population based on the amount of residential development approved for the DRI.  It has to show the locations of proposed parks and recreational facilities, and provide a schedule for the conveyance of parks sites. 

 

Issues/Analysis: As identified in the parks conveyance agreement, a total of 40.2 acres of the approximately 110 acres of land conveyed to the City for Tradition Regional Park counted toward the parks requirements for the Western Grove DRI per the Contract for Sale and Purchase between Tradition Development Company, LLC, and the City of Port St. Lucie in 2008.  An additional 9.8 acres of park and recreation land was required.  In 2023, Mattamy Palm Beach, LLC, as the successor to the Tradition Development Company, conveyed an additional 16.45 acres to the City to expand the footprint of the Tradition Regional Park which exceeded their park requirements by 6.65 acres.  With this agreement, Mattamy Palm Beach, LLC, is donating an additional 5.03 acres of land to the City in the form of a linear strip of land between the park site and the K-8 public school site.  The 5.03 acres provides the City with the ability to add a gate along the western boundary of Tradition Regional Park to connect the park site to the northern driveway at the K-8 school site.  It will provide the City with the ability to utilize the driveway when needed for access to Sundance Vista Boulevard (North/South A).
