Summary Brief (Agreements/Contracts only)
1. Prepared by: Utility Systems Department (“USD”).
2. Parties: City of Port St. Lucie and Florida Power and Light Company (“FPL”).
3. Purpose: To grant FPL entry to the Prineville Water Treatment Facility which will allow for a temporary power source for a drilling rig substation.
4. New/Renewal/Modified: New.
5. Duration: The agreement will automatically expire after completion of the project or five years after the effective date, whichever occurs later.
6. Benefits to Port St. Lucie: This agreement allows FPL to provide temporary electrical services for a drilling rig substation that is needed to assist in the construction of a second injection well at the Prineville Water Treatment Facility.
7. Cost to Port St. Lucie (Annual and Potential): There is no cost to the City for this agreement.

Staff Recommendation: Move that the Council Approve the Temporary Facilities and Right of Entry Agreement for the City Owned Property Located at 1001 SE Prineville Street to Florida Power and Light Company.
Alternate Recommendations:
1. Move that the Council amend the recommendation and Approve the Temporary Facilities and Right of Entry Agreement for the City Owned Property Located at 1001 SE Prineville Street to Florida Power and Light Company.
2. Move that the Council not approve the Temporary Facilities and Right of Entry Agreement and provide staff with direction.
Background: The Prineville Water Treatment Facility deep injection well system is utilized for disposal of concentrate from the reverse osmosis (RO) process. The deep injection well system currently consists of one Class I deep injection well (IW-1). The permitted flow rate of IW-1 is up to 5.1 million gallons per day, which is equivalent to 3,510 gallons per minute for the RO plant at a capacity of 11.15 MGD. The Prineville Injection Well has been operational since 2011. The USD is scheduled to begin construction of a second Class I deep injection well (IW-2) in June 2025. IW-2, which will serve as a secondary injection well for redundancy, will allow the USD to meet disposal capacity needs for the Prineville Water Treatment Facility.
Issues/Analysis: If the City Council does not approve this agreement, the City will have to find an alternative power source.
Financial Information: There is no cost to the City for this agreement.
Special Consideration: This Temporary Facilities and Right of Entry Agreement is required by FPL to provide power for a drilling rig substation that is needed to assist in the construction of a second injection well at the Prineville Water Treatment Facility.
Location of Project: Prineville Water Treatment Facility.
