Summary Brief (Agreements/Contracts only)
1. Prepared by: Florida Department of Environmental Protection.
2. Parties: City of Port St. Lucie (“Grantee”) and the State of Florida Department of Environmental Protection (“FDEP”).
3. Purpose: The City of Port St. Lucie (Grantee) will construct improvements to the Westport Wastewater Treatment Facility (“WWTF’) to achieve Advanced Wastewater Treatment requirements for an effluent quality of 3 mg/l Total Nitrogen and 1 mg/l Phosphorus.
4. New/Renewal/Modified: New.
5. Duration: This agreement is scheduled to expire on April 30, 2028. Extensions are available for this agreement.
6. Benefits to Port St. Lucie: When completed, the project will provide a significant reduction of nutrients in the treated effluent wastewater.
7. Cost to Port St. Lucie (Annual and Potential): This is a cost reimbursement Agreement which FDEP has backdated to allow for past expenses. The City shall be compensated $11,895,847.00 under this agreement.

Staff Recommendation: Move that the Council approve Resolution 25-R53, Authorizing the City Manager to execute Grant Agreement QG024 with the State of Florida Department of Environmental Protection (“FDEP”) for improvements to the Westport Wastewater Treatment Facility and to authorize the City Manager to enter into future amendments to the grant agreement on behalf of the City.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve Resolution 25-R53, Authorizing the City Manager to execute Grant Agreement QG024 with the State of Florida Department of Environmental Protection (“FDEP”) for improvements to the Westport Wastewater Treatment Facility.
2. Move that the Council reject the grant agreement and provide staff with direction.
Background: The Westport Wastewater Treatment Facility was previously in the process of an expansion to treat approximately 12 million gallons a day of wastewater. During phase one of that expansion, regulatory changes occurred through the Basin Management Action Plan (BMAP) that required the treated wastewater effluent to a higher standard. The USD evaluated the regulatory changes and assessed through a cost/benefit analysis the best course of action. It was decided rather than expanding, the treatment facility would under construction improvements to not only meet the current BMAP requirements, but to design and construct the infrastructure to meet Advanced Wastewater Treatment standards. Upon completion, these improvements will reduce the amount of nitrogen and phosphorus that exists in the WWTF effluent and reclaimed water that could make its way to the St. Lucie River.
Issues/Analysis: The tasks within the agreement must be completed by the corresponding task end date. Cost reimbursable grant funding must not exceed the budget amounts as indicated within the agreement.
Financial Information: Funds are appropriated within Utility CIP Fund 448-3512-563000, Project String Y1728 to cover the initial costs. FDEP will reimburse after each task complete.
