3. Purpose: Provide all labor, materials, equipment, and supervision necessary to furnish and install sod throughout the City.

5. Duration: The initial term of the Contract is from June 1, 2025 through June 1, 2027 with one (1), two (2)-year option to renew. This Amendment #1 does not request additional time.
6. Benefits to Port St. Lucie: To keep Port St. Lucie beautiful and environmentally resilient.
7. Cost to Port St. Lucie (Annual and Potential): With the expansion of the service area in Amendment #1, annual estimated expenditures are requested to increase by $800,000.00 for an estimated Contract amount of $1,000,000.00 annually. Future expenditures will be appropriated in each fiscal year’s budget.

Staff Recommendation: Move that the Council approve Amendment #1 to Contract #20250115, to Furnish and Install Sod, to provide additional funding and allow the Contract to be utilized citywide by multiple departments as needed.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve Amendment #1 to Contract #20250115.
2. Move that the Council not approve Amendment #1 to Contract #20250115 and provide staff with direction.
Background: This Contract involves sod restoration associated with ongoing Drainage Right-of-Way improvements and swale regrading activities. As part of the drainage work, existing turf areas are disturbed during excavation, grading, and reshaping of swales designed to improve stormwater flow and reduce localized flooding. Once the drainage and swale rework is completed, the affected areas require restoration with new sod to reestablish ground cover, stabilize soil, and return the site to its intended condition. Approval of Amendment #1 is being requested to expand the scope of the Contract to include all City locations. This expansion will require the Contractor to provide all applicable services-consistent with the existing Contract requirements-across all City locations, as needed and requested by the City.
Nature’s Keeper, Inc. has consistently delivered high-quality service to the City for more than 15 years. Throughout this time, they have demonstrated reliability, professionalism, and strong attention to detail. Their team continues to provide exceptional service across multiple locations citywide, contributing to well-maintained public spaces and supporting the operational needs of various departments.
Issues/Analysis: City Code of Ordinances, Section 35.09(b), states: “For any existing contracts, previously approved by City Council, the City Manager, or his or her designee(s), shall have the discretion, power, and authority to approve increases (1) up to 25% of the original contract price or (2) $99,999.99, whichever is less, for non-construction contracts[.]” Because the increased spending under the Contract requested in Amendment #1 exceeds this threshold, Section 35.09(c) requires City Council approval (“Any charges in excess of the aforementioned amounts may be made only when authorized by the City Council.”).
