3.                     Purpose: The City and District #5 have determined that the Restated Stormwater Agreement should be amended to include under the District #5 responsibilities, maintenance of stormwater pipes relating to Crosstown Parkway.

7.                     Cost to Port St. Lucie (Annual and Potential): The City agrees to pay to District #5 an amount of Verano Stormwater Revenue equal to 75% of the net Stormwater Fees collected by the City during each fiscal year upon property lying within the boundaries of the Verano Districts.

Staff Recommendation: Move that the Council approve the Resolution authorizing the Mayor to enter into an Amended and Restated Interlocal Agreement between Verano District #5 and the City of Port St. Lucie for the extension of Crosstown Parkway.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and approve the resolution.

2.                     Move that the Council not approve the amended agreement and provide staff direction.

 

Background: The Crosstown Parkway extension will be constructed by Kolter Development to provide access to Verano POD G and POD H. The roadway stormwater is designed to flow through the Verano Community Development District boundaries. A portion of the stormwater outfall pipes and related appurtenances, including drainage structures, will be located within drainage easements dedicated to District #5. The City and District #5 have determined that the Restated Stormwater Agreement should be amended to include under the District #5 responsibilities, maintenance of the stormwater facilities that will be located within these drainage easements.

 

Issues/Analysis: This Resolution authorizes the Mayor to enter into the Amended and Restated Interlocal Agreement between Verano District #5 and the City. The Agreement designates and sets forth the responsibilities of each party regarding maintenance of the stormwater facilities and payment to District #5, an amount of 75% of the Verano Stormwater Revenue from the City.

                     

Financial Information: The City agrees to pay to District #5 an amount of Verano Stormwater Revenue equal to 75% of the net Stormwater Fees collected by the City during each fiscal year upon property lying within the boundaries of the Verano Districts.

 

Special Consideration: Execution of the Amended and Restated Interlocal Agreement is critical to the Project.

 

Location of Project: Crosstown Parkway, west of Village Parkway.
