Executive Summary (General Business): This Resolution and accompanying FDOT State Highway Lighting, Maintenance, and Compensation Agreement will allow the City to be compensated for the maintenance and general upkeep of state-owned highway lighting facilities as specified in Exhibit A of the Agreement. The facilities covered under the agreement are located along S.E. Port St. Lucie Boulevard and US Highway 1.

Staff Recommendation: Move that the Council approve the Resolution allowing the execution of the Agreement.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve the Resolution.
2. Move that the Council not approve the Resolution and provide staff direction.
Background: The Florida Department of Transportation and the City of Port St. Lucie originally entered into an agreement for State Highway Lighting, Maintenance and Compensation in 2003. This agreement shall compensate the City for maintaining the lighting along US 1 and S.E. Port St. Lucie Boulevard for a period of seven (7) years. The enclosed agreement indicates the number of lighting fixtures for which the City will continue to maintain and receive yearly compensation. Additionally, the Department recognizes the increasing cost of maintenance and as such has not only increased the compensation amount per fixture for the current year but also included an increase of three percent every fiscal year.
Issues/Analysis: The Resolution authorizes the City Manager, or his designee, to enter into an agreement with FDOT and authorizes City Staff to take actions necessary to implement the terms and conditions of the agreement.
Financial Information: The City of Port St. Lucie (maintaining agency) will receive one single payment at the end of each fiscal year for satisfactory completion of service. The per-light unit rate shall increase by 3% each fiscal year. E.g., the per-light unit rate of $309.10 in fiscal year 2022 shall increase to $318.37 in fiscal year 2023. Fiscal year 2022 compensation amount is anticipated to be $129,512.90.
