Summary Brief (Agreements/Contracts only)

1.                     Prepared by: Robyn Holder, CPPB (PMD).

2.                     Parties: City of Port St. Lucie and Zahlene Enterprises, Inc.

3.                     Purpose: To provide compensation for unforeseen utility conflicts needed to complete the project.

4.                     New/Renewal/Modified: Modified.

5.                     Duration: The initial term began on 9/27/2021 through 3/21/2023. Through several Amendments the time has been extended through 6/6/2025. No additional time is needed for this Amendment.

6.                     Benefits to Port St. Lucie: This project will provide additional intersection capacity, accessible multi-use pathways, pedestrian lighting, underground drainage, and upgraded water and sewer facilities.

7.                     Cost to Port St. Lucie (Annual and Potential): An additional $725,826.93 is needed for the unforeseen utility work for a new Contract amount of $8,984,469.47.

Staff Recommendation: Move that the Council approve Amendment #12 to Contract #20200077 for the Construction of Port St. Lucie Blvd. North Roadway Project with Zahlene Enterprises, Inc.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and approve Amendment #12 to Contract #20200077.

2.                     Move that the Council not approve Amendment #12 to Contract #20200077 and provide staff with direction.

 

Background: On September 23, 2021, the City entered into a Contract with Zahlene Enterprises, Inc. for the construction services described above. The Contract commenced on September 27, 2021, and originally terminated 540 calendar days later on March 21, 2023. The original Contract amount was $8,006,338.18.

 

Amendment #12 incorporates Change Order No. 15 which has been created to combine multiple potential change orders (14, 21, 22, 23, 24, 25, 26, 27 and 28) for extra work due to multiple unforeseen utility conflicts with the 16” force main and 8” gas main, and 16” by-pass at Station 269. Also, compensation for additional work to incorporate fully accessible pedestrian system push buttons at the intersections of Darwin Blvd. and Aurelia, and to compensate for additional work due to incorporating a preemptive glance system at the same intersection. 

 

Issues/Analysis: Staff has reviewed these changes and has received FDOT concurrence to approve the unforeseen scope of work. Staff is recommending approval.

                     

Financial Information: Funds are appropriated in the Road & Bridge CIP / Traffic / Improvements O/T Building/ SW PSL Blvd. Reconstruction (301-4121-563000-Y1717).
