2. Parties: City of Port St. Lucie and American Consulting Engineers, LLC.
3. Purpose: To relocate the existing utilities along Port St. Lucie Blvd. to accommodate the Florida Department of Transportation (FDOT) and the Public Works roadway improvement project.
4. New/Renewal/Modified: Modified.
5. Duration: An additional 914 calendar days ending on 9/1/2023.
6. Benefits to Port St. Lucie: Cost and time savings by using the same design firm as FDOT and Public Works.
7. Cost to Port St. Lucie (Annual and Potential): Amendment #6 is $199,005 for a new Contract amount of $1,148,585.

Staff Recommendation: Move that the Council approve Amendment #6 to Contract #20160085 with American Consulting Engineers, LLC for the design and permitting services for the utility relocation in conjunction with the Port St. Lucie Blvd. “North” road reconstruction project by FDOT.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve Amendment #6 to Contract #20160085.
2. Move that the Council not approve Amendment #6 to Contract #20160085 and provide staff with direction.
Background: American Consulting Engineers, LLC is currently under contract for designing the Port St. Lucie Blvd. “North” reconstruction project for FDOT and the City’s Public Works Department. To minimize the impact to the public and the overall cost(s), the Utility Systems Department (USD) is using the same design firm. The work will provide for design, permitting and bidding assistance for the relocation of the utility services along Port St. Lucie Blvd. from south of Alcantarra Blvd. to south of Darwin Blvd. In order for the City to be included in the project the City had to sign the FDOT Utility Work by Highway Contractor Agreement (UWHCA) which was approved by Council on 11/9/2020. This agreement requires the City to perform all engineering inspections and monitoring of the utility work to insure that it is properly performed in accordance with the plans and to provide FDOT with daily records showing approved quantities and amounts for weekly, monthly and final estimates per FDOT procedures.
The USD does not have the staff to provide full time inspections that would be required to meet the agreement with FDOT. The agreement has been attached for reference.
Issues/Analysis: Staff has reviewed the proposal and finds that it is fair and reasonable.
Financial Information: Funds are appropriated in the budget for the Utility CIP Fund / Preventative Maintenance / Improvements O/T Building (#448-3316 & 3516-563000).
Special Consideration: American Consulting Engineers, LLC is currently under contract with FDOT and the Public Works Department for the design of this roadway.
Location of Project: Port St. Lucie Blvd. south of Alcantarra Blvd. to south of Darwin Blvd.
