Executive Summary: Accept conveyance of Tract RW1 of Kenley from Mattamy Palm Beach LLC, to the City of Port St. Lucie as recorded in Plat Book 104, Page 16, of the Public Records of St. Lucie County, Florida. Note 2 in the legal description as recorded in Plat book 104 Page 16, clearly states Tract RW (Paar Drive) and RW1 are to be to be dedicated to the City of Port St. Lucie for the benefit of the public for road right-of-way purposes.

Staff Recommendation: Move that the Council approve the Resolution accepting the conveyance of Tract RW1 of Kenley from Mattamy Palm Beach LLC, to the City of Port St. Lucie.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve the Resolution accepting the conveyance of Tract RW1 of Kenley.
2. Move that the Council does not approve the Resolution accepting the conveyance of Tract RW1 of Kenley and provide staff with direction.
Background: Mattamy Palm Beach LLC, owns Tract RW1 of Kenley (the “property”) located within Southern Grove.
Issues/Analysis: The Developer is seeking to convey Tract RW1 of Kenley to the City of Port St. Lucie. The Developer has submitted the attached special warranty deed to the City of Port St. Lucie for acceptance. Tract RW1 of Kenley was previously dedicated to the City of Port St. Lucie on the Kenley Plat recorded in Plat Book 104, Page 16 of the Public Records of Port St. Lucie. Through acceptance of this deed the city will also own fee simple title to Tract RW1 of Kenley.
Special Consideration: Tract RW1 of Kenley will be used as a public Right-of-Way.
