2.                     Parties: City of Port St. Lucie and Burkhardt Construction, Inc.

3.                     Purpose: To amend Contract #20240112 for Construction Manager at Risk (CMAR) Services for Torino Regional Park Phase 1, establishing a Guaranteed Maximum Price (GMP) and timeline for construction.

4.                     New/Renewal/Modified: Modified.

5.                     Duration: The initial term began on November 12, 2024, through December 11, 2025.  Amendment #1 extends the Contract for an additional six hundred ninety (690) days through November 1, 2027 (Substantial Completion Date).

6.                     Benefits to Port St. Lucie: Hiring a CMAR for Torino Regional Park Phase 1 has maximized project efficiency, cost control, and quality assurance, reducing risks commonly associated with large-scale municipal projects. With Burkhardt as the CMAR in place, the City has a project partner responsible for mitigating unexpected costs, adhering to the community-driven master plan, and ensuring timely project completion. Burkhardt has worked closely with City staff and the design team to provide early insight into the design, risks, and construction requirements, allowing for proactive planning, better forecasting, tighter cost and schedule control, and a smoother more coordinated construction phase.

7.                     Cost to Port St. Lucie (Annual and Potential): An additional $33,911,015.16 inclusive of a 2% owner’s contingency for a new Contract total of $34,074,035.16.

Background: The City previously entered into a preconstruction services agreement with Burkhardt Construction, Inc. under the CMAR delivery method. Burkhardt has now submitted a GMP for construction in the amount of $33,246,093.29 plus a 2% owner’s contingency in the amount of $664,921.87 for a total GMP of $33,911,015.16.  The city-added owner’s contingency is property of the City and may only be used when approved by the City.

 

Torino Regional Park is a planned 75-acre regional park designed to support the needs of the City’s growing population by expanding recreational amenities while protecting preserved natural space. Phase 1 improvements feature a variety of active and passive recreation elements that will enhance community health, quality of life, and tourism. Components include:

• Dragon’s Lair Skate Park designed to support USA BMX Freestyle events

• Pickleball courts and a covered basketball court

• Destination playground and splash pad

• Walking trails and shaded fitness areas

• Restroom facilities at key activity areas

• Gathering spaces and pavilions

• Maintenance facility and support infrastructure

• Parking areas, internal roadways, utilities, drainage, and lighting

• Site access improvements including a roundabout on NW North Torino Parkway

 

Issues/Analysis: Burkhardt was selected as CMAR through the City’s competitive procurement process. During preconstruction, the CMAR worked collaboratively with City staff and the project’s design team led by Kimley-Horn to refine scope, pricing, and scheduling. The submitted GMP reflects current market pricing and incorporates constructability input received during the design phase.

                     

Financial Information: Funds are appropriated in the fund Parks CIP/Parks and Recreation Parks/Improvements O/T Buildings (Account #305-7210-563000-00000).

 

Special Consideration: Construction is anticipated to begin May 4, 2026, and reach substantial completion by November 1, 2027.

 

Location of Project: Torino Regional Park.
