Executive Summary (General Business): Accept conveyance of an eighty (80) foot right of way for North-South Road A through the Verano DRI from Verano Development LLC, a Delaware limited liability company.
Presentation Information: Staff will be available to answer any questions.
Staff Recommendation: Move that the Council approve the Resolution accepting the conveyance of the right of way.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve the Resolution accepting the right of way.
2. Move that the Council not approve the motion.
Background: Verano Development, LLC (“Developer”) is the master developer of the Verano DRI. The Developer would like to convey the portion of North-South Road A through the Verano DRI required by condition 45 of the approved DRI Resolution, 21-R01. Condition 45 of the Verano DRI states the following:
Developer shall dedicate right-of-way for a two-lane public access roadway (North-South Road A) (80 feet wide) through the Verano DRI. The right-of-way shall be located west of the Florida Power and Light (FPL) power transmission line and extend northerly from the southern boundary of Verano to Glades Cut-off Road. This right-of-way shall be dedicated on or before the commencement of any proposed residential development or PUD approval located west of the FPL easement. Prior to the first residential Certificate of Occupancy west of North-South A, the developer shall construct a 2-lane roadway from Crosstown Parkway to the southernmost residential access.
Issues/Analysis: The developer has submitted an Opinion of Title and Special Warranty Deed to the City in order to facilitate the conveyance of the right of way. Such documentation is attached hereto.
Financial Information: N/A
Special Consideration: P22-023 is currently pending, which is the final and preliminary plat associated with the segment of North-South Road A at issue. Approval of the plat will include approval of construction plans for the infrastructure associated with condition 45 of the DRI.
