Summary Brief: The owner of 8896 S. US Highway 1, Port St. Lucie, Florida, is requesting to abandon the ten (10) foot wide Utility and Drainage Easement, located on the north side of the property, as the structure built on it in the 1980’s was built up to the property line.

Staff Recommendation: Move that the Council approve the Ordinance abandoning the ten (10) foot utility and drainage easement located at 8896 S. US Highway 1, Port St. Lucie, Florida.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve the Ordinance to abandon the ten (10) foot utility and drainage easement located at the Northern side of the property located at 8896 S. US Highway 1, Port St. Lucie, Florida.
2. Move that the Council not approve the abandonment and provide staff direction.
Background: The real property located at 8896 S. US Highway 1, Port St. Lucie, Florida, was platted with a ten (10) foot wide utility and drainage easement. The building was built on the easement up to the property line in the early 1980’s. Therefore, the ten (10) foot wide easement will need to be abandoned. The owner of the property submitted a request for the abandonment to the City.
Issues/Analysis: The request to abandon the easement was evaluated by the Public Works Department, Utility Systems Department, and the Public Utility Companies (AT&T, FPL, Comcast, and Florida City Gas). The City Departments and Utility Companies have no objection to the abandonment of the utility and drainage easement at 8896 S. US Highway 1, Port St. Lucie, Florida.
Financial Information: There will be no cost incurred by the City.
