Executive Summary: The City has received an application from Sidlyd Investments, LLC, on behalf of the property owner, Coast to Coast Investment Properties, LLC, for the 4th Amendment to the Pine Trace PUD. The Pine Trace PUD is comprised of 39.92 acres of mostly developed land.  Coast to Coast Investment properties, LLC, is the owner of Parcel A.  Parcel A is a 2.21-acre vacant commercial parcel.  The proposed PUD amendment revises the development plan for Parcel A.  

 

Presentation Information: Staff will provide a presentation.

 

Staff Recommendation: Move that the Board recommend approval of the proposed amendment to City Council.

2.                     Move that the Board not recommend approval

 

Background: The Site Plan Review Committee recommended approval of the PUD amendment at the January 8th, 2025 meeting.

 

Issues/Analysis: The Pine Trace PUD is approximately 36.71-acres in size and includes 132 single-family residential lots that were constructed by KB Homes. The residential component is built out with a homeowner’s association.  The PUD also includes a one (1) acre utility site and the 2.21-acre vacant Parcel A.  The proposed amendment to the PUD is being put forward without providing evidence of unified control of the entire area within the PUD and a renewed agreement to all provisions per Section 158.177, City Code of Ordinances. Although requested by staff, the applicant has stated that they are not able to secure the required signatures from the homeowner’s association. The proposed changes to the PUD apply only to Parcel A, which is under the ownership of Coast to Coast Investment Properties, LLC.  The previous PUD binding agreement is included as Exhibit A of the PUD document.

                     

Special Consideration: Property notification letters were sent to property owners within 750 feet of the subject property.  The Planning and Zoning Department did notify the current attorney for the HOA that the City had received an application for an amendment to the Pine Tract PUD and provided the date of the Planning and Zoning Board hearing and the dates of the City Council meetings.
