2. Parties: City of Port St. Lucie and CONSOR North America, Inc. fka CONSOR Engineers, LLC fka American Consulting Engineers of Florida, LLC. (“CONSOR”).
3. Purpose: Increase funds to allow for additional design services on the D-11 Canal Stabilization Project.
4. New/Renewal/Modified: Modified.
5. Duration: Current End Date is November 19, 2027.
6. Benefits to Port St. Lucie: Additional design will provide for increased stormwater flow and flexibility in construction.
7. Cost to Port St. Lucie (Annual and Potential): Amendment #10 - $13,400.00, Amendment #11 - $62,800.00, Amendment #12 - $14,100.00, Amendment #13 - $0.00*, and Amendment #14 - $49,901.00 for a new Contract total amount of $2,796,015.00.
*There is a cost listed in Amendment #13, however, that was added to correct an accounting error in a previous amendment, not add new funds.

Staff Recommendation: Move that the Council ratify Amendments #10 through #13 and approve Amendment #14 for the Design & Permitting for Floresta Drive Phases 2 & 3 with CONSOR.
Alternate Recommendations:
1. Move that the Council amend the recommendation and ratify Amendments #10 through #13 and approve Amendment #14 to Contract #20190112.
2. Move that the Council not ratify Amendments #10 through #13 nor approve Amendment #14 and provide staff with direction.
Background: Amendment #14 -The design of the D-1 Canal Stabilization Project was awarded to American Consulting Engineers of Florida, LLC for a period between January 7, 2018, to August 5, 2019. Design was completed and the project remained shovel-ready until 2024 when it was bundled with the construction phase of the Floresta Drive Phase 3 Project. During the review of the existing plans, the contractor requested that the Engineer of Record look at modifications to the plans that would allow for safer, more manageable construction of the stormwater system. After meeting with the project team, it was determined that additional design would allow for greater stormwater flow while also allowing for a more manageable construction process.
The following modifications are requested to be implemented:
• Upsizing the existing 43x68” pipes at the SE Bayharbor Street area upstream of the baffle boxes to match the same pipe size as the upstream 48x76” pipe size (60” round).
• Relocating the existing baffle boxes east, keeping them as close to SE Bayharbor Street as the pipe alignment allows, re-installing them at the optimum elevation for flow and performance.
• Modifying the baffle box structures to accept the larger pipes on the upstream side, adding a riser section as needed, and adding a structure chamber adjacent to the downstream end of each baffle box to accept tie-in of the 72” RCP and the 30” drainage pipe.
• Deleting S-106.
• Utilizing independent structures for each pipe run in lieu of large single structures for the dual pipe runs, including an equalizer pipe between the structures (if needed at any location).
• Utilizing 60” PP (ADS HP) in lieu of 48x76” ERCP.
Amendment #13 - $0.00:
A time extension for post design services for Phase 3. Post design services will include attending the pre-construction meeting, answering questions regarding the construction plans or technical aspects of the construction documents during the construction process, attend the construction progress meetings (as needed), and resolve any design issues identified in the field during construction.
Amendment #12 - $14,100.00:
The Consultant will prepare and update final construction plans and contract documents to include final quantities and technical specifications. This includes updating final probable cost estimates, and technical specifications for all aspects of the proposed work (for inclusion into City bid package), table of pay items, units and estimated quantities.
Amendment #11 - $62,800.00:
The Consultant will provide Engineering, Permitting, and Surveying for updating the Floresta Drive Phase 3 plans to add baffle box water quality structures at D-8 and D-10 Canal crossings and modify the environmental resource permit.
Task 1 - Engineering: The Consultant will evaluate the flows and flood stages of the D-8 and the D-10 Canals with the introduction of baffle boxes. The Consultant will coordinate with the baffle box manufacturer (EcoVault), include the baffle boxes in the modeling, and provide details for the baffle box construction. The Consultant will prepare a drainage report for the D-8 and the D-10 Canal.
Task 2 - Permitting: The Consultant will prepare and submit a SFWMD permit application to permit modifications to the approved permit plans.
Amendment #10 - $13,400.00:
Task 1 - Preliminary Design Services: The Engineer will gather survey & geotechnical data and prepare 30% Construction plans for the SE Bywood Avenue Water Main Extension.
Task 2 - Final Engineering Services (100%) & Bid Documents: The Engineer will prepare 100% Construction Plan Set including, but not limited to the following sheets:
Ø Key Sheet
Ø Summary of Pay Items
Ø Utility Plan & Profile
Ø General Notes & Details
Task 3 - Permitting Services: The Engineer will prepare & submit the forms and documents that are required for obtaining regulatory and construction permit approvals for the project. The Engineer will respond to each agency’s comments / questions for each permit. PLSUSD will be responsible for all permit fees.
Issues/Analysis: Council approved all previous Amendments. Since then, the amount of the Contract Amendments has remained under City Council threshold pursuant to City Code of Ordinances, Section 35.09(b). Amendment #14 requires City Council approval under Section 35.09(b). Staff is requesting Council ratify Amendments #10 through #13 and approve Amendment #14. Staff has reviewed the Amendments and finds them to be fair & reasonable.
Financial Information: Funds are appropriated in the Stormwater CIP Fund / Drainage / Design Services (#401-4126-563004-00000).
