3. Purpose: To provide a final amendment to close out the Contractor’s work on the project.
4. New/Renewal/Modified: Modified.
5. Duration: Amendment #4 does not add or remove any Contract time.
6. Benefits to Port St. Lucie: To close out the Contractor’s work on the project and permit the City to utilize other third-parties to complete the project.
7. Cost to Port St. Lucie (Annual and Potential): The initial Contract amount was $846,741.60, and Amendment #4 reduces the Contract total by $242,715.49. If Amendment #4 is approved by Council, the new Contract total will be $604,026.11.

Staff Recommendation: Move that the Council approve Amendment #4 to Contract #20220109 for Import Drive Sidewalk Construction Project - Phase 2.

Background: The Import Drive Sidewalk Construction Project (“project”) has not yet reached completion. The Contractor and the City have mutually decided to close out the Contractor’s obligations under the Contract. In exchange, the Contractor has agreed to reduce the Contract price by $242,715.49. To complete the project, staff has engaged a third-party company to complete the work, including the addition of several upgrades to what had been included in the original project scope. The total amount of the work required to complete the project, including the upgrades and construction engineering and inspection services, will be less than $242,715.49, the amount deducted from the Contract in Amendment #4.
Issues/Analysis: Staff has relayed that completion of the project is a vital step, as there is resurfacing scheduled for the area to begin in October 2026. Work on the sidewalk project is scheduled to be completed by the time of the 9/28/26 Council meeting.
Financial Information: By executing Amendment #4 and utilizing third-party contractors to complete the project, the City is saving roughly $18,000 on the total project cost, with the added bonus of receiving the additional upgrades.
