Background: The Plat was approved for recording by City Council at the Regular City Council Meeting on April 12, 2021 as Legistar Item No. 2021-310; Agenda Item 11.e Resolution 21-R37, A Resolution Approving the Final Plat with Construction Plans for Belterra Phase 1 Plat 1 (21-015).  The Plat contains on its face, in Dedication Number 5, a dedication of public utility easements (the "PUE Dedication") in favor of the City. The PUE Dedication allows the installation of landscaping and other improvements within areas covered by the PUE Dedication, subject to the conditions stated therein. The City and the Developer have determined there exists a need for an amendment to the PUE Dedication on the Plat in such regard.
