3. Purpose: Provide Construction Manager at Risk Services for Torino Regional Park Phase 1, ensuring that the project is efficiently planned, managed, and delivered within the approved budget and timeline.
4. New/Renewal/Modified: New.
5. Duration: Eight Hundred and ten (810) calendar days with no option to renew.
6. Benefits to Port St. Lucie: Hiring a CMAR for Torino Regional Park Phase 1 will maximize project efficiency, cost control, and quality assurance, reducing risks commonly associated with large-scale municipal projects. With a CMAR in place, the City gains a project partner responsible for mitigating unexpected costs, adhering to the community-driven master plan, and ensuring timely project completion. While the design team, led by Kimley-Horn, will coordinate the detailed aspects of design-including specialized amenities like the splash pad, skate park, and environmental services-the CMAR will work closely with them to ensure these plans are executed smoothly. This collaborative approach supports a seamless, high-quality delivery that meets the City’s recreational needs and enhances overall project success.

Cost to Port St. Lucie (Annual and Potential): One-time expense of $163,020.00 for the preconstruction services including progress meetings and scheduling, constructability review, value engineering, life cycle cost analysis, cost estimating, permit tracking and coordination, and guaranteed maximum price development.

Staff Recommendation: Move that the Council award Contract #20240112 for Construction Manager at Risk Services for Phase 1 of Torino Regional Park to Burkhardt Construction, Inc.
Alternate Recommendations:
1. Move that the Council reject the recommended award and provide staff with direction.
2. Move that the Council reject all proposals and provide staff with direction to reissue the solicitation or cancel the Request for Qualifications.
Background: On June 24, 2024, the City Council approved the Torino Regional Park Phase I Conceptual Master Plan. The park site spans 220 acres, encompassing three primary parcels (192 acres) and an additional potential parcel (28 acres). The Torino Regional Park Conceptual Master Plan was developed with extensive community input to ensure alignment with local recreational needs and preferences.
Phase I will focus on Parcel A, key features that may include trails, public art installations, a splash pad, skate park, pickleball courts, a destination playground, and a large group pavilion. Recently, Council approved an amendment to Kimley-Horn’s contract to oversee the design and coordinate all the various sub designs, including the skate park, splash pad, and other specialized amenities.
A Request for Qualifications was issued in accordance with Section 287.055, Florida Statutes, identified as the Consultants’ Competitive Negotiation Act (CCNA) on August 1, 2024, to 905 potential consultants. There were 3 proposals received on September 5, 2024. PMD held the first evaluation committee meeting on September 23, 2024, to review and discuss the proposals and individual scores to determine the short list. The Evaluation Committee selected and voted to move all three firms forward to the short list. The firms were invited to a second evaluation meeting held on October 15, 2024, to make presentations and to answer more detailed questions regarding the project. The Evaluation Committee reviewed their scores and adjusted accordingly. The final scores were announced as followed:

#2 Ranked Firm: The Collage Companies - 5467.00
#3 Ranked Firm: Kaufman Lynn Construction, Inc. - 5436.00
PMD began negotiations with the top ranked firm, Burkhardt Construction Inc. After the negotiations, an agreement for preconstruction services was made to accept the proposal of $163,020.00.
As of FY24/25, a total Phase 1 project budget of $21,365,000.00 has been allocated, comprising $5,541,600.00 in ARPA funds (obligated as SLFRF, or State and Local Fiscal Recovery Funds), $9,730,000.00 from Reserve Bond Proceeds, $2,093,400.00 from Park Impact Fees, and $4,000,000.00 from the SLC Interlocal Agreement Impact Fees. The Kimley-Horn Design Contract, totaling $1,816,700.00, was obligated as of October 28, 2024, with City Council approval. The remaining budget available for all CMAR (Construction Manager at Risk) oversight and construction activities totals $19,548,300.00.
Executing Contract #20240112 will obligate the $5,541,600.00 in SLFRF funds by the 12/31/24 deadline. With all procurement standards met and no additional federal funding sources involved, the City is positioned to proceed with Phase I as planned.
Issues/Analysis: Staff has reviewed the final proposal and finds that the fees are fair and reasonable for the amount of work needed to complete this project.

Special Consideration: At the completion of the preconstruction services, the Contractor will prepare a Guaranteed Maximum Price (GMP) and project schedule which will be placed on a future Council agenda for approval prior to commencing the construction phase of the project.
