3. Purpose: The USD is seeking to waive the bidding for acquisition of materials for the Naranja Area Sewer improvements to acquire materials from Ferguson Waterworks, Inc. Felix Associates of Florida, Inc. has agreed to provide the work once materials are received pursuant to Contract #20200043.

Staff Recommendation: Move that the Council waive bidding, per Chapter 35.04(c) of the City’s code of ordinances, for good cause shown and approve the immediate purchase of materials from Ferguson Waterworks needed for immediate repairs to the Naranja and RiverPark area wastewater system.
Alternate Recommendations:
1. Move that the Council amend the recommendation and complete the motion in the affirmative.
2. Move that the Council not approve and provide staff with direction.
Background: The COVID pandemic has impacted the USD in many ways - one of the largest impacts are to staff and materials shortages resulting in current City contracts and contractors unable to honor pricing. Blue Goose Construction, LLC and Felix Associates of Florida, Inc., both under contract with the City (pursuant to E-bid #20200043), were unable to honor their material pricing due to circumstances beyond their control. Supply chain and material shortages have led to an increase in pricing occurring nationwide. Any further delay in performing these repairs bears the potential risk to the health, safety, and welfare of the community, and going out to bid to make the repairs may delay the improvements by 4-5 months. Therefore, the USD is requesting to purchase materials using the quotes attached hereto and using Felix Associates (as the low bidder) to perform the installation of the low pressure main with the materials acquired herein. To expedite this project, the USD received quotes from Core & Main and Ferguson Waterworks for the purchase of materials to make certain repairs for the Naranja sewer improvements. If approved, the USD anticipates delivery of the requested materials in 8-10 weeks. It is important to note that prior incidents have occurred, and the USD has committed to making immediate improvements and necessary repairs to the Florida Department of Environmental Protection (FDEP) for compliance with all applicable regulation. The USD does not want to delay these needed repairs by going out for bid.
Issues/Analysis: The USD received quotes from Core & Main and Ferguson Waterworks and Blue Goose for both the materials and labor, but Blue Goose was unable to honor its pricing. Ferguson Waterworks provided lower prices, so the USD recommends approval of the attached quotes to purchase the necessary materials for the Naranja Sewer Improvements. The USD is removing the low-pressure system from the gravity system to mitigate potential harm in the future.
Financial Information: Estimated cost of $74,768.60 for materials for Phase I and $24,040.12 for Phase II, for a total estimated cost of $98,808.72 from the CIP Account #448-3516-563000-00000.
Special Consideration: Section 35.04 of the City’s code authorizes a waiver of the provisions of the requirement to competitively bid certain purchases if, for good cause shown, and upon written recommendation by the City Manager, the City Council, by affirmative vote, authorize the purchase of goods, supplies, materials or services without competitive bid.
