3. Purpose: Replacement of the 17-year-old Reverse Osmosis (“RO”) membranes is anticipated to provide an increase in finished water quality, a reduction in operating costs due to lower operating pressures and the ability to produce quality drinking water at the plant design production capacity for the next decade.

5. Duration: Through September 30, 2024.
6. Benefits to Port St. Lucie: Increase in drinking water quality and a reduction of operating costs for the next decade. Typical life span of RO membranes is 10 years.
7. Cost to Port St. Lucie (Annual and Potential): FY 21 (1st year) = $402,280; FY 22 (2nd year) = $267,000; FY 23 (3rd year) =$401,000; FY 24 (4th year) = $267,000; Total = $1,337,280.

Staff Recommendation: Move that the City Council waive the bidding per Chapter 35.04(c), of the City’s code of ordinances for good cause shown and approve Toray Membrane USA, as the Single Source provider for TMG20D - 440 elements.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve Toray Membrane USA, as the Single Source provider for TMG20D - 440 elements.
2. Move that the Council not approve Toray Membrane USA, as the Single Source provider for TMG20D - 440 elements.
Background: Pilot testing was performed on three membrane element manufacturers (Lanxess, Dupont, and Toray). Based upon pilot testing results, the Toray elements meet the City’s water quality goals, provided the lowest power and operating costs, and require the fewest necessary upgrades to the existing skids.
Issues/Analysis: Staff has reviewed the pricing and finds that it is acceptable. The Sole Source memo was posted on DemandStar for seven (7) days per Section 287.057(3)(c), Florida Statutes. No disputes were submitted.
Financial Information: Funds are appropriated in the 438 Capital Budget.
Special Consideration: The City’s purchasing code provides, for good cause shown and upon written recommendation by the city manager, the city council, by affirmative vote, may waive the competitive bidding requirements and authorize the purchase, or authorize the making of an offer to purchase any goods, supplies, materials or services without competitive bidding (See Sec 35.04(c), City’s code of ordinances).
