Executive Summary (General Business): Request for City Council to declare City-Owned real property as surplus and to dispose of the real property through an online auction. The parcel identification number and address of each property is referenced in “Attachment A”. The properties referenced in Attachment A shall be collectively referred to herein as the “Subject Properties.” 

 

Presentation Information: If desired, staff is available to present.

 

Staff Recommendation: Move that the Council approve the surplus designation of the Subject Properties and approve disposing of the Subject Properties through an online auction.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and approve the surplus designation of the Subject Properties and direct staff in the preferred method of property disposal.

2.                     Move that the Council not approve the surplus designation of the Subject Properties  and provide staff with direction.

 

Background: The Subject Properties identified in Attachment A escheated to the City by way of the St. Lucie County Commission. The Subject Properties are being presented to City Council for consideration to designate them as surplus and for sale pursuant to City Policy# 18-01ccd.

 

Three of these parcels are a part of the River Point PUD First Replat. The City Attorney’s Office has communicated with the affected HOA’s attorney, who advised that the HOA may be interested in purchasing these parcels or would at least request that the City subject the parcels to the HOA Declaration prior to the City selling them. This action would not stall the balance of properties from commencement of disposition following Council approval. Attachment A provides detailed information on each property. An agenda item to present an offer, should the HOA wish to purchase the three parcels, will be presented at a future meeting of the City Council.

 

Issues/Analysis: Following the requirements that are established in City Policy# 18-01ccd, all City Departments verified that they had no use for the Subject Properties.

 

City Policy #18-01ccd provides for two methods of disposal of surplus real property, auction, or Request for Proposal (RFP). The policy further provides the City Council with the right to dispose of surplus real property by any other means in the best interest of the City, upon motion by the City Council. An example would be the use of a Real Estate Broker.

 

It is staff’s recommendation that the City dispose of the subject properties through an online auction as the highest bidder being awarded the property pays the auction fee so there is no cost to the City. A Broker fee for this service would be a percentage of the total for which the property sold; this would be paid by the City. The RFP process is a written solicitation for competitive sealed proposals in accordance with the City’s Purchasing Policy and Procedure Manual. The PMD Director advises this process would take 2-3 months to complete. 

 

Prior to commencement of the sale of the properties, an appraisal to establish the minimum price for the sale is required and notification to all property owners within 300’ of each property to be sold must be notified of the sale by first class mail. All sales, regardless of the method used, must be finalized by an Ordinance in accordance with the terms and provisions of the City Charter Section 9.09(g). 

                     

Financial Information: A one-time revenue to the City and a potential increase to the tax roll.
