2. Parties: City of Port St. Lucie and Xylem Water Solutions USA, Inc.
3. Purpose: Provide a sole source continuing service contract for the repair, rebuilding and purchasing of new submersible pumps used to transport sanitary sewage from lift stations to the wastewater plants.
4. New/Renewal/Modified: New.
5. Duration: 1-year with automatic renewals each year until canceled or amended.
6. Benefits to Port St. Lucie: Provide continuous supply of residential and commercial grinder pump systems for wastewater collection services.
7. Cost to Port St. Lucie (Annual and Potential): Estimated annual expenditures are between $700,000.00 to $1,000,000.00. Future expenditures will be approved in each year’s budget.

Staff Recommendation: Move that the Council approve the Sole Source supply, per City Code of Ordinances, Section 35.08(a)(25)(a)(1) & (6) (where the compatibility of equipment, accessories, or replacement parts is of paramount consideration; there are no commercially available substitutes for these components and/or replacement parts, which can only be purchased from the manufacturer or the distributor).
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve the Sole Source Contract #20260045 for the supply of residential & commercial grinder pump systems.
2. Move that the Council not approve the Sole Source Contract #20260045 and provide staff with direction.
Background: While under contract with E.K. Phelps in 1995, the Utility Systems Department (“USD”) began purchasing Flygt pumps to be used throughout the Utility Service Area. Throughout the years, the Flygt brand has been passed to Xylem Water Solutions USA, Inc. who is now the sole provider of Flygt products and services as well as the only authorized service repair and warranty organization in the State of Florida.
The USD currently maintains approximately 322 lift stations, a number that increases annually as new developments are brought online. Each of these stations relies on submersible pumps, which are subject to failure due to the demanding nature of their use. Timely repair/replacement and purchasing of new submersible pumps are critical to ensure the sanitary sewer system remains operational.
This Sole Source continuing contract is recommended to streamline procurement and response time for urgent pump failures. This will also ensure OEM parts and certified service for warranty compliance.
Issues/Analysis: Staff has reviewed the current price list and finds it to be acceptable. Flygt products have been used throughout the Utility Service Area since 1995. The Sole Source notice was posted on OpenGov for seven (7) days as required by the City’s Procurement Policies & Procedures.
Financial Information: Funds are appropriated in the Utility Renewal & Replacement Fund / Lift Stations / Improvements O/T Building (#438-3380-563000-00000).
