Summary Brief (Agreements/Contracts only)
1. Prepared by: City of Port St. Lucie and Mattamy Palm Beach, LLC.
2. Parties: City of Port St. Lucie and Mattamy Palm Beach, LLC.
3. Purpose: Mattamy Palm Beach, LLC agreement requesting permission to construct park and recreation amenities at the Tradition Regional Park Property and approval of stated Impact Fee Credits.
4. New/Renewal/Modified: New.
5. Duration: Twenty-four months from effective date.
6. Benefits to Port St. Lucie: Contractors are currently mobilized onsite completing Phase 1a early earthwork as stated in the previously approved and executed sitework agreement. Mattamy’s plans for Phase 1b amenity construction are in the final phases and it is anticipated that contractors will be poised to begin construction of all agreed upon infrastructure and amenities once agreements have been approved and executed.
7. Cost to Port St. Lucie (Annual and Potential): Mattamy Constructed amenities agreement cost = $22,847,418.36. Musco lighting and Digital Sign City of PSL direct purchase cost = $2,008,000. Total Phase 1b Amenity Construction Cost = $24,855,418.36.

Staff Recommendation: Move that the Council approve the construction of Park and Recreational Facilities for Tradition Regional Park and the Park Impact Fee Agreement.

Background: On March 9, 2020, City Council Meeting Agenda item 2020-229, Lucido & Associates provided a brief presentation and received City Council’s approval to begin the planning process for Tradition Regional Park on behalf of developer, Mattamy Homes.
Lucido & Associates facilitated the Tradition Regional Park Resident Stakeholder Meeting in-person and online via Zoom, June 17, 2020. On December 14, 2020, City Council Meeting Agenda item 2020-931, City Council discussed Tradition Regional Park amenities.
April 19, 2021, City Council conceptually approved the Tradition Regional Park Master Plan and approved Lucido & Associates, the Agent for Mattamy Homes, to initiate construction drawings for “Phase I” development of the park. On June 30, 2023, Mattamy Homes presented a tiered approach to the construction of the Tradition Regional Park. A proposed pre-work contract would include sitework and some utility coordination, in advance of the main scope of constructing park amenities. On July 3, 2023, the tiered approach to the construction of the Tradition Regional Park was accepted by City Management and staff. On July 5, 2023, staff requested a formal proposal from Mattamy. Mattamy Homes provided an Early Site Work proposal (Phase 1a) for the Tradition Regional Park agreement on August 3, 2023 and submitted cost and exhibits for the proposal agreement on September 8, 2023. This agreement was approved by City Council on September 25, 2023 and began working onsite upon agreement execution. Early site work is ongoing and is currently in the final stages of completion.
Issues/Analysis: Through coordination with City Management, Parks & Recreation Department, Planning & Zoning Department, Public Works Department, Procurement Management Department, and the City Attorney’s Office, it was determined the best approach would be to request authorization to waive the bidding requirements and utilize the Developer’s Contractor to complete construction for the Phase 1b facilities and amenities at the Tradition Regional Park site.
Financial Information: City Bond and Reallocated Project Funds = $20,676,290, Mattamy City Impact Fee Credits = $2,100,000, Mattamy County Impact Fee Credits = $2,750,000 (contingent on approval of County Impact Fee Credit Agreement with County, Mattamy agreed to cover cost anticipated to be funded by County credits if County Impact Fee Credit Agreement fails per this Agreement). Total funds available for Phase 1a and Phase 1b construction = $25,526,290
Special Consideration: Recommended to waive the bidding, Chapter 35.04(c), for good cause, to construct Tradition Regional Park.
