Summary Brief (Agreements/Contracts only)
1. Prepared by: Shelby Dolan, Procurement Management Division (PMD).
2. Parties: City of Port St. Lucie and (1) Aquatic Vegetation Control, Inc. (Area A); and (2) Rion Construction, LLC (Area B) (collectively, “Contractors”).
3. Purpose: To provide swale liner maintenance services for Area A and Area B as depicted on pages 47 and 48 of the RFP (Attachment 8).
4. New/Renewal/Modified: New.
5. Duration: Three (3) years, with the option for three (3) one (1) year renewals.
6. Benefits to Port St. Lucie: To provide swale liner maintenance at various locations outlined in Area A and Area B of the City and allow for installation of swale liner and repairs to existing swale liner.
7. Cost to Port St. Lucie (Annual and Potential): Estimated annual expenditure for Area A is $3,666,800.00 and the estimated annual expenditure for Area B is $3,264,600.00, with a total estimate expenditure of $ $6,931,400.00 for FY 26-27. All future expenditures will be as budget allows per the unit prices identified in the Contracts. Please see table below for breakdown.

Staff Recommendation: Move that the Council award Contracts #20250205 and enter into contracts with (1) Aquatic Vegetation Control, Inc. for Area A, and (2) Rion Construction, LLC for Area B.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve Contracts #20250205.
2. Move that the Council not approve Contracts #20250205 and provide staff with direction.
Background: These Contracts provide for the ongoing maintenance of the City’s swale liner system through a unit-price, per-mile maintenance program. The Contracts allow for maintenance services to be performed on a continuous rotation of up to six (6) times per year during the term of the Contracts. The actual number of maintenance rotations performed each year may be less than six, at the City’s sole discretion and based on the condition of the swale liners and the availability of budgeted funds.
During Year 1, an initial clean-up period will be conducted to assess the existing condition of the swale liner system and address areas requiring additional attention before regular maintenance rotations can be fully implemented. Following the initial clean-up, the Contractors may perform up to five (5) additional maintenance rotations during the first Contract Year. Beginning with Year 2 and continuing through any renewal periods exercised by the City, the Contractors will provide up to six (6) maintenance rotations per year, subject to the City’s determination of service needs and available funding.
In addition to routine maintenance, the Contracts establish unit prices for swale liner installation and repairs. Installation services may be required for newly constructed homes where a swale liner has not previously been installed. Repair services may be utilized when an existing swale liner has been damaged and requires restoration or replacement.

This unit-price structure provides the City with flexibility to obtain maintenance, installation, and repair services as needed, while allowing the City to manage the frequency and extent of services based on system conditions, operational needs, and available funding.
Issues/Analysis: The RFP was issued on June 9, 2026, to one thousand seven hundred and seventy-eight (1,778) potential suppliers. There were thirty-three (33) plan holders with three (3) proposals submitted on July 17, 2026.
A team of 5 Evaluation Committee members meet on August 18, 2026 to discuss the 3 proposals and individual scores. Based on the scores, the Committee recommended moving forward with Question & Answers with all 3 companies:
1. Aquatic Vegetation Control, Inc.
2. Brightview Landscape Services, Inc.
3. Rion Construction, LLC
On August 27, 2026 the Committee met with all 3 companies for Question & Answers and based on the responses received, it was determined to move forward with the intent to split the award of this contract for these areas between these 2 companies:
1. Aquatic Vegetation Control, Inc. - Area A
2. Rion Construction, LLC - Area B
Negotiations began on September 16, 2026 and concluded September 28, 2026. Based on the final submittals the department has recommended to move forward with the following for the identified Areas:
• Aquatic Vegetation Control, Inc. (Area A) - Yearly Cleaning total $2,416,800.00
• Rion Construction, LLC (Area B) - Yearly Cleaning total $1,629,600.00
Financial Information: Funds are appropriated in the adopted FY budget for Stormwater / Greenbelt / Liner (#401-4127-534105-00000) and Stormwater / Environmental / Road Materials and Supplies(#401-4126-563000-26PW015P).
Special Consideration: Contractual provisions have been added to protect the City, should one of the Contractors not be able to perform, for any reason. Both Contractors (in the Contracts) have undertaken the obligation to assume responsibility for the other area if that should occur, to minimize disruptions in service, at the same unit prices/rates and on the same pricing basis as the prices, rates, and basis of the assuming Contractor’s Contract.
