Executive Summary (General Business): This is a request for a special exception use to allow a proposed Convenience Store and Fueling Station located at the northwest corner of SW Becker Road and SW Port St. Lucie Boulevard as set forth in Section 158.124(c)9 of the City Zoning Code and as set forth in Section 2.3.3.1.a of the Becker Road Overlay District Design Standards.
Presentation Information: Staff will provide a presentation.
Recommendation: The Planning and Zoning Board recommended approval of the proposed SEU application on August 2, 2022 (without the condition recommended by staff).
Alternate Recommendations:
1. Move that the Council approve the proposed SEU amendment with the condition recommended by staff as shown below or approve with other condition:
Multiuse Sidewalk - Prior to Site Plan approval, the proposed 8-foot-wide multiuse sidewalks located within the frontage landscape buffer shall be revised to be 10 feet in width. Or the existing 10-foot-wide multiuse sidewalks shall remain located within the Becker Road and Port St. Lucie Boulevard rights-of-way and new 7-foot-wide multiuse sidewalks shall be located within the frontage landscape buffer as required by Section 5.5.1 of the Becker Road Overlay District (BROD) Design Standards.
2. Move that the Council not approve the recommendation and provide staff direction.

Currently, there are existing 10-foot-wide multiuse sidewalks located in the rights-of-way of both Port St. Lucie Boulevard and Becker Road. These sidewalks are on City property. The Public Works Department approved allowing the applicants to remove the sidewalks from within the street right-of-way with the condition that instead of having two sidewalks that there would be one 10-foot-wide sidewalk internal to the site.
With sidewalks remaining in the street rights-of-way, the combined total width of sidewalk would be 7 feet (internal sidewalk) and 10 feet (existing sidewalk in street right-of-way) or 17 total feet. The proposed sidewalks are 8-feet-wide, and not 10-feet as required by Public Works.
