Summary Brief (Agreements/Contracts only)

1.                     Prepared by: Robyn Holder, CPPB (PMD).

2.                     Parties: City of Port St. Lucie and Johnson, Mirmiran & Thompson, Inc. (JMT).

3.                     Purpose: To provide increased funding to the CEI & GEO contract to accommodate the Florida Department of Transportation (FDOT) Grant Application Process (GAP) closeout documents and the Transportation Regional Incentive Program (TRIP) Agreement’s current expiration date.

4.                     New/Renewal/Modified: Modified.

5.                     Duration: Amendment #9 extended the Contract through 12/31/2025. Amendment #10 extended the Contract through 6/30/26. Amendment #11 does not require additional time, so the end date remains June 30, 2026.

6.                     Benefits to Port St. Lucie: The Port St. Lucie Blvd. Segment 3 Project will provide additional intersection capacity, accessible multi-use pathways, pedestrian lighting, underground drainage and upgraded water and sanitary facilities.

7.                     Cost to Port St. Lucie (Annual and Potential): Amendments #9 and #10 did not add additional cost to the Contract. Amendment #11 adds an additional $264,230.00 for a new contract amount of $1,947,705.00.

Staff Recommendation: Move that the Council ratify Amendments #9 & #10 and approve Amendment #11 for the CEI & GEO Services for the Port St. Lucie Blvd. North Segment 3 Project with JMT.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and ratify Amendments #9 & #10 and approve Amendment #11 to Contract #20230117.

2.                     Move that the Council not ratify Amendments #9 & #10 nor approve Amendment #11 to Contract #20230117 an provide staff with direction.

 

Background:  On September 12, 2023, the City of Port St. Lucie executed a contract with Johnson, Mirmiran & Thompson, Inc. (JMT) for CEI & GEO Services for the above referenced project. This contract commenced on September 12, 2023, and originally terminated 200 calendar days thereafter on March 30, 2024. The original contract amount was $659,656.00.

 

Amendment #1 was executed on March 5, 2024, which extended the contract term only through August 31, 2024.

 

Amendment #2 was executed on June 25, 2024, which increased the contract value by $442,564.50 and extended the contract time through December 9, 2024.

 

Amendment #3 was executed on December 19, 2024, which extended the contract time only through May 2, 2025.

 

Amendment #4 was executed on January 13, 2025, which increased the contract value by $266,528.50.

 

Amendment #5 was executed on April 28, 2025, which extended the contract time only through July 31, 2025.

 

Amendment #6 was executed on July 29, 2025, which increased the contract value by $170,736.00 and extended the contract time through September 18, 2025.

 

Amendment #7 was executed on October 17, 2025, which extended the contract time only through November 2, 2025.

 

Amendment #8 was executed by City Council on October 13, 2025, and added $143,990.00 to the contract and extended the contract term through November 30, 2025.

 

Amendment #9 extended the contract term only through December 31, 2025.

 

Amendment #10 extended the contract term only through June 30, 2026.

 

Amendment #11:

 

Based on conversations at the 12/3/2025 GAP Documentation Meeting, there was an agreement that the contract time on this project should be extended to June 30, 2026, to accommodate the GAP closeout documents and the TRIP Agreement’s current expiration date.

 

The City was presented with two (2) funding analyses. Scenario #1 - The Senior Inspector would stay on the project through January 31, 2026; and Scenario #2 - The Senior Inspector would stay on the project through June 30, 2026.

 

                     Scenario #1 would cost $264,230.00.

                     Scenario #2 would cost $359,830.00.

Upon review of the remaining construction work required to finalize the project, it has been determined that Scenario #1 will provide sufficient inspection coverage while also allowing for concurrent GAP closeout documents to be processed.

 

Issues/Analysis: Council has approved all previous Amendments and Amendment #9 & #10 were for time extension which did not require Council approval pursuant to City Code of Ordinances, Section 35.09. Since Amendment #11 requires Council approval pursuant to Section 35.09(b), staff is requesting Council ratify Amendments #9 & #10 and approve Amendment #11. Staff has reviewed the Amendments and find them to be fair and reasonable.

                     

Financial Information: Funds are appropriated in the Road & Bridge Fund / Traffic / Improvements O/T Building / SW PSL Blvd. Reconstruction. (#304-4121-563000-Y1717).
