3.                     Purpose: Special warranty deed that conveys the pieces missing on the west side of the North-South “A” Road which were not properly included in the original Special Warranty Deed for the road.

Staff Recommendation: Move that the Council approve acceptance of the Special Warranty Deed in substantially the same form as attached hereto.

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and approve acceptance of the Special Warranty Deed in substantially the same form as attached hereto.

2.                     Move that the Council not approve the Special Warranty Deed.

 

Background: The City previously took title to the majority of property intended to be utilized for North-South “A” Roadway within the Verano DRI.  However, in the process of reviewing title with the plat (North-South “A” Roadway Plat (P22-023)) associated with the Roadway it was determined that the safe site corner clips and a small 80’ x 20’ section of the property intended to be utilized as roadway according to the proposed plat had not been previously conveyed to the City.  The Applicant and the City would like to include these missing segments as part of the plat.

 

 

 

Issues/Analysis: The City has requested that the developer Verano Development, LLC cause the missing portions of North-South “A” to be conveyed to the City prior to processing the related plat.  The developer has proposed accomplishing this via the attached Special Warranty Deed from its related entity, PSL Land Investments, LLC, the owner of the missing portions of property.

 

 

Financial Information: N/A

 

Special Consideration: The conveyance and acceptance of the property is a condition precedent to processing the final plat for North-South “A” Roadway Plat (P22-023).
