Summary Brief (Agreements/Contracts only)

1.                     Prepared by: Elizabeth Hertz, Senior Deputy City Attorney, Office of the City Attorney.

2.                     Parties: City of Port St. Lucie and Mattamy Palm Beach, LLC.

3.                     Purpose: Mattamy requests authorization to proceed with the construction of the improvements contemplated by the Stars and Stripes Site Plan (P22-195), as approved by the City of Port St. Lucie City Council on November 13, 2023.

4.                     New/Renewal/Modified: New Agreement.

5.                     Duration: 18 months from date of construction commencement.

6.                     Benefits to Port St. Lucie: The Stars and Stripes Park will enrich the cultural and artistic ambiance of the City generally and enhance the immediate geographic area in which the improvements will be constructed. It will improve the Parks and Recreation 10-Year Master Plan level of service (LOS) and the City’s initiative to provide parks within a 10-minute walk for residents of Port St Lucie.

7.                     Cost to Port St. Lucie (Annual and Potential): Annual Operating and Maintenance Cost estimate to include one FTE = $140,350.00.

Staff Recommendation: Move that the Council approve the Stars and Stripes Park Improvement and Art Donation Agreement.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and approve the Stars and Stripes Park Improvement and Art Donation Agreement.

2.                     Move that the Council not approve and provide staff direction.

 

Background: The proposed Stars and Stripes Park is 47.52 acres and will be constructed by Mattamy Palm Beach, LLC, in compliance with the approved site plan.  Mattamy Palm Beach, LLC and the City entered into a Right of Entry Agreement on December 15, 2022, to begin site work in advance of the Park Improvement Agreement execution. 

 

Mattamy is not seeking reimbursement or impact fee credits for capital improvements and will gift the finished park to the City upon completion (without restrooms).

 

Issues/Analysis: The Stars and Stripes Park is proposed to include: a celestial classroom with planetary sculptures, sundial, a monument acknowledging emergency first responders, a parking lot with future overflow parking, irrigation and landscaping and sewer water service stub outs for a future restroom.  A restroom is proposed to be included in the Parks & Recreation FY 2024-2025 Capital Improvement Plan (CIP) budget request.

                     

Financial Information: Cost of Mattamy donated improvements = $5,807,756.  Project costs with bonding = $6,969,307.20.
