title
Ordinance 22-74, Public Hearing, An Ordinance Amending the Boundaries of the LTC Ranch West Residential Community Development District
body
Submitted By: Elizabeth L. Hertz, Senior Deputy City Attorney
Strategic Plan Link: The City’s Mission to plan for smart and balanced growth.
Executive Summary (General Business): The LTC Ranch West Residential Community Development District (“District”) has requested that the City approve a boundary change to the District.
Presentation Information: Questions will be answered upon request.
Staff Recommendation: Move that the Council approve the expansion request.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve the request.
2. Move that the Council not approve the request.
Background: The City created the District on June 14, 2021, by adopting Ordinance 21-53 after reviewing the District’s initial establishment petition. In the original petition to establish the District, the Petitioner availed itself of the provisions of 190.046(1)(h) which allows a petitioner to identify sufficiently contiguous expansion parcels which may be added to the CDD within 10 years of the effective date of ordinance. This process allows the City to evaluate not only the initial boundaries of the CDD but also the proposed expansion parcel boundaries all at once so that any future boundary amendment can proceed on a simplified and expedited basis upon the filing of a Petition to expand. In particular, section 4 of Ordinance 21-53 did this.
Issues/Analysis: The District has submitted its Petition to expand and add parcels that were previously evaluated as a part of the initial establishment process and approved in Ordinance 21-53. It is noteworthy that the only required elements to make this addition under 190.046(1)(h)1. are:
a. A new legal description of the parcels to be added
b. A new overall legal description for the CDD
c. The written consent of the owners of the parcel to be added
d. A map of the district including the parcel to be added
e. Prescription of the development proposed on the additional
f. A copy of the original petition identifying the parcels to be added.
Financial Information: The only annual costs the City faces are the minimal costs of receiving and reviewing the various reports that the District is required to provide to the City. The Petitioner’s estimated project costs of constructing the services, based on available date, are shown in the Petition. Any debt obligations incurred by the proposed District to construct its infrastructure, or for any other reason, are not debts of the State of Florida or any unit of local government. In accordance with State law, debts of the District are strictly its own responsibility. The City would be responsible for maintenance costs of infrastructure built outside of the CDD boundaries.
Special Consideration: The original Petition contains the information required by section 190.046(1)(h), Florida Statutes, to include the Expansion Property.
