Executive Summary (General Business): Mattamy Palm Beach, LLC, and the School Board of St. Lucie County have signed the Second Amended and Reinstated Educational Facilities Impact Fee Credit Agreement between Mattamy Palm Beach, LLC, the School Board of St. Lucie County, Florida, and the City of Port St Lucie. The agreement pertains to public school requirements of the Southern Grove DRI and the Annexation Agreement and requires City Council approval prior to the recording of the agreement.

Background: Condition 62 of the Southern Grove DRI development order, as approved through Resolution 21-R136 and as amended by Resolution 24-R55, requires a development agreement between the developer of the Southern Grove DRI and the School Board for the dedication of two K-8 school sites. The original agreement was approved on September 17, 2007. It provided for a formula for the reimbursement of educational impact fees that would normally be assessed of dwelling units within the proposed development as well as conveyance of the required school sites to the School Board. There was a first amendment to the agreement that was signed by Mattamy Palm Beach, LLC, and the School Board that was never recorded.
Issues/Analysis: The Agreement provides a map of the required school sites (Map H of the DRI). It includes a future school site on the north side of Becker Road west of the intersection of SW Village Parkway and Becker Road that is identified as the First School Site in the agreement. The second school site is located at the southwest corner of the intersection of the E/W 2 right-of-way and SW Village Parkway which is referred to as the Second School Site in the agreement. The City of Port St. Lucie acquired ownership of the second school site in 2018. In negotiations with the developer and the City, the School Board has determined that the second school site is no longer needed. The proposed second amendment to the agreement provides for the City to retain ownership of the second school site. The City will provide payment to the School Board for the appraised value of the Second School Site in lieu of conveyance of the land.
