Executive Summary (General Business): Request that City Council declare and designate City-Owned real property legally described as Lot 2, Block 242, of South Port St. Lucie Unit 17, a Subdivision According to the Plat thereof, Recorded in Plat Book 19, Page 23, of the Public Records of St. Lucie County, Florida (the “Property”), as surplus and authorize the disposal and conveyance of the Property to Ishrat Khurshid with Metro Realty (“Buyer”).

 

Presentation Information: Staff will be present to answer any questions.

 

Staff Recommendation: Move that the Council approve the surplus designation of the Property and authorize the conveyance of the Property to Ishrat Khurshid.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and approve the surplus designation of the Property and authorize the conveyance of the Property to Ishrat Khurshid.

2.                     Move that the Council not approve the Property for surplus and retain in the City’s inventory.

 

Background: The Buyer has contracted to purchase the lot adjacent to the Property and located at 1450 SE Larkwood Circle, both of which are within the Rivergreen Villas development along Veterans Memorial Parkway (across from Lyngate Park). This is a duplex-only community in which lots can be sold separately, however both lots are required to commence construction simultaneously and, being a duplex, conjoined with a common wall.

 

The Property escheated to the City by the St. Lucie County Board of County Commission on April 2, 2024, unbeknownst to the City. The Property recently went before the High-Performance Public Spaces (“HPPS”) Team for review where it was determined there was no viable public purpose for the City to own half of a duplex in a residential community; therefore, the HPPS Team recommended the City sell the Property to the Buyer after obtaining an appraisal, thus adding it to the tax roll. 

 

The appraisal was completed on June 27, 2024, through the City Attorney’s Office and determined the lot value at $55,000. Buyer has agreed to purchase the Property for the appraised amount.

 

City Policy #18-01ccd requires any asset valued over $15,000 be declared as surplus and the sale be approved by the City Council.

 

Issues/Analysis: The HPPS Team verified that the City has no use for the Property. City Policy #18-01ccd provides for two methods for disposal of surplus real property, auction or Request for Proposal (RPF). However, the policy further provides the City Council with the right to dispose of surplus real property by any other means in the best interest of the City, upon motion by the City Council.  

 

Staff recommends selling the Property to Buyer without an RFP or auction. The Property is situated in a duplex-only community in which lots can be sold separately, however both lots are required to commence construction of a duplex. Since Buyer is purchasing the 1450 Lot and agreed to purchase the Property at the appraised price, this is the most reasonable method to dispose of the Property.

                     

Financial Information: One-time revenue to the City and a potential increase in the tax roll.
