Executive Summary (General Business): This application is a corrective plat to fix an error in the legal description for Southern Grove Plat No. 28.  Southern Grove Plat No. 28 was approved on January 11, 2021 (Resolution 21-R04) and the plat was recorded on January 13, 2021 (PB 91-36).  After the plat was recorded, a typographical error was discovered by the underwriter for the lender.  The underwriter notified the owner, Baron Shoppes, LLC, that a corrective plat would need to be approved by the City Council and recorded to rectify the error.  

 

Presentation Information: Staff may provide a short presentation. 

 

Staff Recommendation: Move that the Council adopt the resolution approving a corrective plat for Southern Grove Plat No. 28. 

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and adopt the resolution. 

2.                     Move that the Council not adopt the resolution and provide staff direction. 

 

Background: Southern Grove Plat No. 28 is a replat of Southern Grove Plat No. 18, Lot 3 that created three parcels form a 4.80-acre tract.   There is an associated site plan for Baron Shoppes at Tradition (P20-004) that was approved by the City Council on September 28, 2020 to allow for a phased commercial development that will include a 9,303 square foot mixed use retail and restaurant building, a 6,699 S.F. car wash, and a 3,390 S.F. stand -alone fast food/drive-through restaurant. 

 

Issues/Analysis: The City Surveyor has reviewed the corrective plat and confirmed that the error in the legal description has been corrected.

Location of Project: The property is located south of SW Tradition Parkway, west of SW Village Pointe, and east of SW Community Boulevard.
