Summary Brief (Agreements/Contracts only)

1.                     Prepared by: City Attorney’s Office

2.                     Parties: City of Port St. Lucie BDG Port St. Lucie, LLC (“Developer”) and the City of Port St. Lucie (“City”) 

3.                     Purpose: Facilitate construction of transportation network improvements required by Section 4(D)(1) of the Fourth Amendment of the Planned Unit Development Document for Gatlin Plaza (P23-159).

4.                     New/Renewal/Modified: New.

5.                     Duration: The outside completion date for the roadway improvements required by the Roadway Improvement Agreement is August 1, 2026.

6.                     Benefits to Port St. Lucie: Provides necessary supporting infrastructure for new development.

7.                     Cost to Port St. Lucie (Annual and Potential): Upon turnover of the public portion of the roadway improvements the City will be responsible for regular maintenance.

Staff Recommendation: Move that the Council approve the Roadway Improvement Agreement.

1.                     Move that the Council amend the recommendation and approve the Roadway Improvement Agreement.

2.                     Move that the Council not approve the Roadway Improvement Agreement.

 

Background: On July 28, 2025, the City Council of the City of Port St. Lucie approved the Fourth Amended of the Planned Unit Development Document for Gatlin Plaza (P23-159) (“Amended PUD Document”).  Section 4(D)(1) of the Amended PUD Document requires the Developer to provide, prior to the issuance of any building or site development permits (excluding mass grading permits) collectively authorizing more than 400,000 square feet of commercial space, an agreement for the following transportation network improvements (the “Roadway Improvements”).

 

Intersection of Gatlin Boulevard & Brescia Street:

a.                     Convert the northbound approach to this intersection (Brescia Street) to two (2) left-turn lanes and one (1) shared through/right-turn lane.

b.                     Extend eastbound Gatlin Boulevard, right turn lane approximately 300 feet from its current position to provide for an approximate doubling of the length of the existing lane.

c.                     Extend the shared northbound ‘through/right-turn lane’ approximately 160 feet from current position to approximate access drive at Home Depot site.

d.                     Provide for necessary Signal Head and Signal Adjustments to support this intersection improvement and lane adjustment.

Intersection of Fondura Street and Gatlin Boulevard:

a.                     Add northbound right turn lane.

b.                     Provide for necessary Signal Head and Signal Adjustments to support this lane addition.

East side Driveway 2 & Hayworth Avenue:

a.                     Convert the intersection of the Gatlin Plaza Internal Access Drive with Hayworth Avenue to an ‘All-Way’ stop controlled intersection.

b.                     Improve sight-triangle visibility at intersection.

Intersection of Hayworth Avenue & Edgarce Street:

a.                     Restripe the Hayworth Avenue & Edgarce Street intersection to provide enhanced traffic operation visibility.

b.                     Remove stop signs for Hayworth Avenue, allowing for free flow movement along Hayworth Avenue.

 

 

Issues/Analysis: Developer and the City wish to enter into the attached agreement to facilitate Developer’s compliance with the requirements of the Amended PUD Document to construct the Roadway Improvements. The Roadway Improvement Agreement requires Developer to construct the Roadway Improvements by August 1, 2026. The City has the option to call a roadway improvement bond and construct the Roadway Improvements itself in the event the Developer defaults under the Agreement.

Special Consideration: Pursuant to Section 24 the Roadway Improvement Agreement, Section 4(D)(1) of the Amended PUD Document will not be deemed satisfied until the Roadway Improvement Agreement is executed by both parties;  a Memorandum of Agreement is recorded in the Public Records in substantially the same form as attached to the Roadway Improvement Agreement; a Roadway Improvement Bond is submitted and accepted by the City; and approval and recording a Temporary Construction Easement to facilitate construction of the Roadway Improvements in the event of Developer default under the Roadway Improvement Agreement.
