2. Parties: The City of Port St. Lucie and NUE Urban Concepts, LLC.
3. Purpose: The Florida Legislature adopted House Bill 479 (with an effective date of 10/1/2024) that amends Florida Statute 163.3180 related to Concurrency and 163.31801 related to Impact Fees. The amendments to Florida Statute 163.3180 essentially implemented the Mobility Plan and Mobility Fee that the City Council adopted as of October 1, 2021, prior to the mediated settlement with the County. These legislative changes, coupled with lessons learned by the City implementing the Mobility Plan and fees to date, as well as the challenges faced getting roadway segments constructed, bring us to a demonstrated need to update the Mobility Plan and related study at this time.

5. Duration: Four hundred and fifty-six (456) days, with options for three (3) additional twelve (12) month renewal terms.
6. Benefits to Port St. Lucie: The City benefits by updating the Mobility Plan and Fee to be consistent with legislative changes and will also negotiate a revised Interlocal Agreement. The updated Mobility Plan and Fee will enable the City to capture increased fees to mitigate the costs of new development. It will also ensure that the City is planning for infrastructure improvements to support the growth and residents into the future. Once the updated Plan is adopted, the City will generate new revenues that would be available to support the increasing number of City infrastructure needs and capital investments resulting from growth and development.
7. Cost to Port St. Lucie (Annual and Potential): The costs associated with this request is $560,000.00.

Staff Recommendation: Move that the Council waive the bidding per Chapter 35.08(c), for good cause shown, and approve Contract #20240146 to update the Mobility Plan and Mobility Fee study with NUE Urban Concepts, LLC.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve Contract #20240146.
2. Move that the Council not approve Contract #20240146 and provide staff direction.
Background: On January 26, 2021, the City Council heard a presentation on Mobility Fees by Jonathan B. Paul, Principal at NUE Urban Concepts, LLC. On February 22, 2021, City Council approved to waive the bidding requirement for the contract with the consultant, NUE Urban Concepts, LLC to prepare a Mobility Plan and Mobility Fee Ordinance. Late Fall of 2021, the City and County entered the Conflict Resolution process as outlined in Chapter 164, Florida Statute, to address the Mobility Fee, the County’s Road Impact Fee, and Park Impact Fees. After a joint meeting between the government bodies and mediation, the City and Couty agreed upon an acceptable Interlocal Agreement, which required the City to update its Mobility Plan and Fee. NUE Urban Concepts prepared the previous Mobility Plan and Fee Study and is the most suitable vendor to provide an updated Mobility Plan and Fee Study. The projected cost of this update will require a budget amendment that will be presented to the City Council at a subsequent meeting.

Financial Information: The funds are appropriated in the General Fund/ General Government / Professional Services (#001-1900-531000).
Special Consideration: The Consultant’s deadline to complete the updated Mobility Plan and Mobility Fee update is October 1, 2025.
Location of Project: Staff is requesting Council waive formal bidding for good cause shown based on the statutory amendment and NUE Urban Concepts, LLC’s previous work with the City. NUE Urban Concepts, LLC’s experience with the City provides historical knowledge that cannot be obtained elsewhere.
