Executive Summary (General Business): A City initiated text amendment to Chapter 155, Sign Code, by amending Section 155.03 - Sign Regulation Procedures
Presentation Information: Staff may provide a presentation.
Staff Recommendation: Move that the Council approve the proposed text amendment as recommended by the Planning and Zoning Board at their June 7, 2022 meeting.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve the proposed text amendment.
2. Move that the Council not approve the proposed text amendment and provide staff direction.
Background: Section 155.03(H) of the City’s Sign Code currently contains the criteria for creation of a Master Sign Program. One of the criterions is the following, “A design review board shall be established for the proposed program. The design review board shall review all sign applications for consistency with specific provisions of the approved master sign program. The design review board must approve each sign, prior to the submittal of any required city sign applications”.
City Staff, including the City Attorney’s Office, recommends removal of this provision from the Master Sign Code criteria as it allows private entities to determine compliance with City adopted Master Sign programs rather than the City. Instead, City Staff recommends that the Planning and Zoning Department review signs for compliance with a City adopted Master Sign program. This modification to the Master Sign Program regulation enhances the City’s autonomy over its own regulations by preventing interference by third parties.
