Executive Summary (General Business): On February 22, 2024, Council approved to reimplement the enforcement of a swale liner program and authorized the Public Works Department to commence the transition from a conventional swale re-work program to reimplementation and enforcement of the swale liner program.

 

Presentation Information: Staff will be available to answer questions if needed.

 

Staff Recommendation: Move that the Council approve the first reading of the ordinance change and move to the second reading of the Ordinance change.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and  provide staff with direction.

2.                     Move that the Council not approve the recommendation and provide staff with direction.

 

Background: At the February 24, 2021, and July 21, 2021, City Council Workshops, Council directed staff to prepare a presentation on the history of the swale liner practice and an evaluation on the use of swale liners.  On November 21, 2022, staff presented a history of the swale liner program, a review of the City’s swale liner services along with the costs of each of those services, drainage requests, the need for swale liner, swale liner removal, and the benefits and disadvantages of swale liner.  At the conclusion of the presentation, Council approved to discontinue the swale liner program and move forward with a swale re-work program.  After a year of evaluating the natural swale program, staff presented at the Winter Workshop and recommended the reimplementation and enforcement of the swale liner program stating the benefits of doing so. On February 22, 2024, the City Council approved Public Works’ recommendation. The Public Works Department will develop a plan to schedule the installation of swale liners throughout the City.

Financial Information: This program will be funded by our Operation and Maintenance fund #401-4126-000-0000. 

 

Special Consideration: The ordinance revision is to reiterate that this program will once again be enforced. However, it should be noted that section 56.20(a) of the City Code already requires “[p]lanning, design, permitting, construction, operation and maintenance requirements for a stormwater management system are provided in the Engineering Standards for Land Development” The Engineering Standards for Land Development were not modified to remove the swale liner requirement in 2022.
