Executive Summary (General Business): The proposed artwork includes a sculptural kinetic collaboration piece by J. Carvallo and Maria Andreina Gonzalez. The estimated footprint is 8’ by 5’ and the sculpture height is 9- to 12’. The piece will have a concrete stand and base that will serve as a seating area around it. The sculpture will be constructed of powder-coated aluminum pieces anchored to the concrete backing.

Staff Recommendation: Move that the Council adopt the resolution to approve the artwork as recommended by the Public Art Advisory Board.
Alternate Recommendations:
1. Move that the Council amend the recommendation and adopt the resolution.
2. Move that the Council not adopt the resolution and request the 1% payment in the amount of $33,134.16 into the City’s Public Art Fund, or provide direction.
Background: All private development meeting the applicability requirements of the City’s public art ordinance is subject to a public art assessment of one percent of the total dollar amount of a project’s total construction costs. The public art assessment is capped at $100,000. In general, there are four methods available for development projects to satisfy the City’s public art requirements. The first option is to provide artwork on site. The second option is to pay a fee in lieu and the third option is a combination of the two. The fourth option is an Alternative Equivalent Proposal, which allows a developer to apply to combine the public art assessment for multiple projects into one larger work of art in lieu of several small works of art.
Issues/Analysis: The applicant is providing artwork on site. On February 12, 2021, the City Council approved a Major Site Plan application for two 10,400 square-foot commercial/office buildings at the southwest corner of Gatlin Boulevard and East Calabria Circle. The applicant submitted a proposal to the City’s Public Art Advisory Board (PAAB) for an onsite permanent public art sculpture. The Public Art Advisory Board (PAAB) recommended approval of the artwork at their August 15, 2022 meeting.
The proposed artwork includes a sculptural kinetic collaboration piece by J. Carvallo and Maria Andreina Gonzalez. The estimated footprint is 8’ by 5’ and the sculpture height is 9- to 12’. The piece will have a concrete stand and base that will serve as a seating area around it. The sculpture will be constructed of powder-coated aluminum pieces anchored to the concrete backing. The graphics are attached for your review. Once complete, the artist will name the sculpture.
The development is currently under construction and has not received a Certificate of Occupancy (CO). The project’s estimated construction costs are $3,313,416.66. Since a local artist has been commissioned to provide the work of art, the value of the work of art cannot be less than ninety percent (90%) of one percent (1%) of the total construction costs, which would require an artwork valued at $29,820.74. The applicant has indicated that the artwork is estimated to cost $50,000, exceeding the minimum requirement.
Financial Information: The maintenance of the artwork is the responsibility of the property owner.

Location of Project: The artwork will be located on the project site at 1208 Gatlin Boulevard, placed between the pedestrian area between the two buildings.
