2. Parties: City of Port St. Lucie and Johnson, Mirmiran & Thomson, Inc. (JMT).
3. Purpose: Provide immediate inspection services for the Port St. Lucie Blvd. Segment 3 Construction Project.
4. New/Renewal/Modified: New.
5. Duration: 200 calendar days.
6. Benefits to Port St. Lucie: The project will provide additional intersection capacity, accessible multi-use pathways, pedestrian lighting, underground drainage, and upgraded water and sanitary facilities.
7. Cost to Port St. Lucie (Annual and Potential): One-time expense of $659,656.00.

Staff Recommendation: Move that the Council waive the bidding, per Chapter 35.04(c), and award the Contract #20230117 to Johnson, Mirmiran & Thomson, Inc. for the CEI and Geotech Services for the Port St. Lucie Blvd. Segment 3 Construction Project.
Alternate Recommendations:
1. Move that the Council amend the recommendation and award Contract #20230117.
2. Move that the Council not approve Contract #20230117 and provide staff with direction.
Background: The City Council awarded this project to CONSOR Engineers, LLC on April 26, 2021. As of August 1, 2023, CONSOR Engineers, LLC acquired American Consulting Professionals, LLC, the Designer of the project. Per the terms of the TRIP Agreement with the Florida Department of Transportation (FDOT) and the contract with the City of Port St. Lucie, this acquisition has created a conflict of interest between the Designer and the CEI. Upon notification that a conflict of interest existed, staff began talks with FDOT to determine the appropriate course of action. Based on these discussions, it was determined that the contract with CONSOR Engineers, LLC must be terminated so that a new consultant can be assigned without causing significant delays to the project and to avoid a loss of participation in funding from FDOT.
Issues/Analysis: Staff has reviewed the proposal from the consultant and finds the cost to be in line with the current engineering contracts with the City.
Financial Information: Funds are appropriated in the Road & Bridge CIP Fund / Traffic / Improvements O/T Buildings-Professional Services / SW Port St. Lucie Blvd. Reconstruction (#304-4121-563005-Y1717).
Special Consideration: JMT is currently providing CEI and Geotech Services on the adjacent Port St. Lucie Blvd. Segment 2.1 Project and, as such, has a working relationship with the contractor, Zahlene Enterprises, Inc. (ZEI) who is also constructing Segment 3. JMT has also confirmed that they have the staff available to begin coverage with no delay to construction.
Location of Project: Port St. Lucie Blvd. west of Gatlin Blvd.
