2.                     Parties: City of Port St. Lucie and Mattamy Palm Beach, LLC

3.                     Purpose: Marshall Parkway has been deeded to the City as a public roadway, recorded in Official Records Book 2899, Page 2933. A 35-ft by 35-ft triangular corner clip is required as additional right-of-way for future intersection improvements and equipment. This corner clip will be included in the final plat of Marshall Parkway. Additionally, a drainage and irrigation easement is required to convey roadway drainage from Marshall Parkway into the stormwater ponds within Del Webb subdivision and to allow irrigation of Marshall Parkway landscaping from the Del Webb stormwater pond.

6.                     Benefits to Port St. Lucie: Provides necessary right of way for roadway improvements.

7.                     Cost to Port St. Lucie (Annual and Potential): There will be no cost to the City for this corner clip and easements.

Staff Recommendation: Move that the Council Approve the Resolution Authorizing the Acceptance of the Special Warranty Deed and Drainage and Irrigation Easement.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and Approve the Resolution Authorizing the Acceptance of the Special Warranty Deed and Drainage and Irrigation Easement.

2.                     Move that the Council not approve the resolution and provide staff direction.

 

Background: The preliminary plat and construction plan for Marshall Parkway at Southern Grove was approved by City Council on May 22, 2023, by Resolution 23-R56. A corner clip is required at the southeast corner of Marshall Parkway and Community Boulevard for future roadway intersection improvements and equipment. Additionally, a drainage and irrigation easement is necessary to convey roadway drainage from Marshall Parkway into the stormwater ponds within Del Web subdivision and to allow irrigation of Marshall Parkway landscaping from the Del Webb stormwater pond. On February 13, 2024, Del Webb Homeowners Association conveyed a 35-ft by 35-ft triangular corner clip to Pulte Home Company, LLC via Quit Claim Deed (ORB 5311, Pg 2154) and Pulte Home conveyed the corner clip to Mattamy Palm Beach, LLC via Special Warranty Deed (ORB 5311, Pg 2159). Mattamy Palm Beach, LLC is conveying this corner clip to the City of Port St. Lucie to be included as additional right-of-way in the Marshall Parkway at Southern Grove final plat. Additionally, a drainage and irrigation easement is being conveyed to the City of Port St. Lucie to allow conveyance of roadway drainage from Marshall Parkway into the stormwater ponds within Del Webb subdivision and to allow irrigation of Marshall Parkway landscaping from the Del Webb stormwater pond.

 

Issues/Analysis: Approval of this resolution conveys the corner clip to the City of Port St. Lucie.

                     

Financial Information: There is no cost to the City.

 

Special Consideration: The conveyance of the corner clip to the City is necessary to facilitate the approval of the final subdivision plat for Marshall Parkway at Southern Grove.

 

Location of Project: Marshall Parkway, from west of SW Cerise Drive to Community Boulevard.
