2. Parties: City of Port St. Lucie and Action Sports Design, LLC.
3. Purpose: Parks and Recreation is seeking approval on a sole source distributor Action Sports Design, LLC for the construction of a USA BMX-sanctioned adaptive racetrack, pump track, and bicycle safety training facility at Tradition Regional Park. The project will be delivered using the Construction Manager-at-Risk (CMAR) method with a Guaranteed Maximum Price (GMP).

5. Duration: The term of the Contract shall be six (6) months from the date of Contract execution.
6. Benefits to Port St. Lucie: The construction of a USA BMX-sanctioned adaptive racetrack, pump track, and bicycle safety facility at Tradition Regional Park is a key initiative of the PSL Parks and Recreation 10-Year Master Plan and directly supports Strategic Plan Goal 6: Culture, Nature, and Fun Activities. Located within what will become the City’s first regional park, this project contributes to establishing a one-of-a-kind destination that offers inclusive recreational opportunities for residents of all ages and abilities. It also strengthens the City’s ongoing commitment to youth programming, active lifestyles, and bicycle safety education. Once complete, the facility will serve as a regional attraction, drawing participants and visitors from across Florida and beyond, and supporting Port St. Lucie’s emerging role in the state’s sports and recreation economy. In addition to the physical infrastructure, the completed facility enables a long-term partnership with USA BMX, the world’s largest youth cycling organization. Through this relationship, the City will benefit from ongoing programming, access to sanctioned events, and national exposure that supports both sports tourism and economic development.
7. Cost to Port St. Lucie (Annual and Potential): ). The selected GMP option utilizes City Direct Purchases, resulting in an anticipated cost savings of over $115,000.00. The total proposed GMP under this approach is $5,889,252.39 which includes a 7% contingency and the CMAR project management fee. All unused contingency funds will be returned to the City through a deductive change order at project close out.

Staff Recommendation: Move that the Council award Sole Source Contract #20250012, per Chapter 35.08(a)(24)(a)(1), for Construction Manager at Risk (CMAR) All-Wheel Adaptive BMX Racetrack for Tradition Regional Park.
Alternate Recommendations:
1. Move that the Council amend the recommendation and award Contract #20250012 with Action Sports Design, LLC.
2. Move that the Council not approve Contract #20250012 with Action Sports Design, LLC and provide staff with direction.
Background: On July 10, 2023, City Council approved Contract No. 20230085 with Action Sports Design, LLC (ASD) in the amount of $328,980 for full design services related to the BMX facility, which will be located within Tradition Regional Park, the City’s first regional park. ASD has since completed the full design, which served as the basis for developing the proposed construction agreement.
In order to maintain sanctioning by USA BMX, the City’s facility must be built to specific specifications. ASD is one of the only firms recognized by USA BMX as qualified to both design and construct such a facility. Since ASD already performed the design services, it is also uniquely qualified for this specific project, intimately knows the design, and can make adjustments more easily.
Maintaining sanctioning by USA BMX is vastly important to the City. Only facilities that are sanctioned by USA BMX can host official events through the organization. These events are deeply important to the City-not only because they bring in tourism, which has a wide-spread and far-reaching positive impact on local businesses and residents-but also because they give the community something to rally around.
Sanctioning opens the door to hosting national events, which generate a ton of revenue on their own. But the impact doesn’t stop there. It also brings in riders and families from across Florida-Miami, Palm Beach County, and beyond-not just for the big races, but even for the weekly races. These regular events help create consistent traffic and activity, offering ongoing support for local hotels, restaurants, and small businesses.
BMX events help strengthen the City’s identity by offering exciting opportunities for families, athletes, and spectators to connect. They put Port St. Lucie on the map for major sports tourism and give residents-especially young people-something to be proud of, something to be part of. That’s why keeping USA BMX sanctioning in place isn’t just a technical detail-it’s a key piece of what makes all this possible and keeps the momentum going.
As evidence of its abilities, ASD has delivered more than 350 action sports parks globally - including Olympic-level BMX facilities - and is known for its expertise in precision grading, surfacing, and construction of integrated all-wheeled environments. Their experience allows them to deliver cohesive, high-performance tracks tailored to community needs and national standards.
As an additional measure of safeguard to the single source request, the City posted a limited-duration solicitation as part of a controlled procurement process tailored to specialty vendors. Under this process, ASD submitted a construction proposal based on the Construction Manager-at-Risk (CMAR) delivery method, with a Guaranteed Maximum Price (GMP) structure and an alternate GMP using City Direct Purchases to reduce costs. The City is required to post the sole source to its electronic bidding system. The sole source was posted on the Electronic Bidding System on May 21, 2025, with no responses received.
The current award recommendation represents the next phase in executing the BMX component of the regional park and will enable construction to begin as early as July 2025, with a projected six-month duration, weather permitting.
Issues/Analysis: Staff has reviewed the proposal provided by Action Sports Design, LLC and finds it to be fair and reasonable.
