3.                     Purpose: Installation of new 30-inch & 24-inch raw water transmission mains to service future well sites F-37, F-38 & F-39.

5.                     Duration: Ratififcation of Amendments #1 - #4 included additional time detailed below. Amendment #5 does not include a time extension. The expiration date remains 02/28/2026.

6.                     Benefits to Port St. Lucie: The new mains are essential for the transmission of raw water from new Floridan Aquifer wells to the JEA Water Treatment Facility (“WTF”), allowing for increased potable water production.

7.                     Cost to Port St. Lucie (Annual and Potential): An additional $206,893.00 is being requested for a new Contract total of $7,794,320.70.

Staff Recommendation: Move that the Council ratify Amendments #1 - #4 and approve Amendment #5 to Contract #20220112 for the Western Raw Water Main Construction Project with Accurate Drilling Systems, Inc.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and ratify Amendments #1 - #4 and approve Amendment #5 to Contract #20220112.

2.                     Move that the Council not ratify Amendments #1 - #4 nor approve Amendment #5 and provide staff with direction.

 

Background: Over the past 15 years, the Utility Systems Department (“USD”) has seen changes in raw water quality from existing JEA Floridan Aquifer wells. In order to reduce the burden on the wellfield, as well as increase water quality and production, the USD is investing in additional Floridan wells in the area of the Wylder Community. To convey the raw water from these wells to the JEA WTF, a transmission main is required. These wells will also support the existing wellfield by allowing rotation, downtime for well maintenance, and time to recharge.

 

Amendment #5: During construction of this project, at the point of connection within the JEA WTF, the contractor encountered some unforeseen electrical duct banks that prevented them from proceeding with the work. A field change was not available. This is more field data needed to develop revised plans to address a new pipeline alignment. The revised plans made use of the on-site materials where possible but ended up needing additional ductile iron (DI) fittings and above grade pipe assembly in order to deal with the electrical duct bank conflict. This required an additional cost of $206,893.00.

 

Amendment #4: Additional time was needed due to the significant number of delays with this project, some of which are Contractor-related items or other items that occurred that were out of the Contractor’s control. The Contractor has been cooperative in all aspects of the work including FDOT remediation work within I-95. The Contractor has been given the green light to move forward with all work excluding the bore within I-95, the Contractor-requested time extension of 161 days was reasonable. The schedule does not address one important aspect of the work that does not have approval yet, and that is the bore under I-95. It is uncertain when that will be issued, which is pending the conclusion of the remediation work.

 

Based on the uncertainty of the I-95 bore approval and authorization from FDOT to proceed, the parties agreed to an interim Contract time extension of 108 days, until February 28, 2026. By that time, we will know the I-95 bore schedule and remediation resolution and could issue a final Contract time extension and the time to complete the remaining work.

 

Amendment #3: Additional time was needed due to the length of time involved in negotiating/approving Change Order No. 1, plus the time delay associated with the delivery of the project’s valves. The Contract end date was extended to November 12, 2025.

 

Amendment #2: After the award of the project, the Contractor was provided with a Conformed Set of Construction Plans. Some lengths of pipe, additional fittings, and an additional roadway crossing were added to the plans. Additionally, the Contractor is proposing shifting some of the drills and installing a portion of the open-cut with a directional bore. The additional cost was $91,752.20. No additional time was needed.

 

Amendment #1: Revised Purchase and Delivery of Materials language was added through this Amendment. No additional time or cost was associated with this Amendment.

 

Issues/Analysis: City Council approval is needed for Amendment #5. Since the previous Amendments were under the City Council threshold pursuant to City Code of Ordinances, Section 35.09(b), and its predecessor ordinance, until Amendment #5, staff is requesting City Council approval under Section 35.09(b). Staff has reviewed the Amendments and finds them to be fair and reasonable.

                     

Financial Information: Funds are appropriated in the Utility CIP Fund / JEA Water Plant / Improvements O/T Building (#448-3312-563000-00000).

Location of Project: Due to Homeland Security protection, the location of the facility is not disclosed.
