2.                     Parties: City of Port St. Lucie and Tencarva Machinery Company, LLC, a foreign limited liability company authorized to do business in the State of Florida.

3.                     Purpose: To purchase a Seepex, Inc. biosolids pump (“Seepex Pump”) for wastewater plant operations.

4.                     New/Renewal/Modified: N/A

5.                     Duration: N/A

6.                     Benefits to Port St. Lucie: This pump is to be utilized as a back-up should existing pump failure occur during operations.

7.                     Cost to Port St. Lucie (Annual and Potential): A one-time expenditure of $147,160.00.

Staff Recommendation: Move that the Council waive bidding, pursuant to Section 35.04(c) of the Code of Ordinances, and approve the purchase with Tencarva Machinery Company, LLC for the Seepex Pump.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and waive the competitive procurement requirement and authorize the purchase for the Seepex Pump.

2.                     Move that the Council not waive the bidding requirement and provide staff with direction.

 

Background: Section 35.03 of the City’s code of ordinances requires competitive bidding on all purchases over $75,000.00 for non-construction related activity. However, because this pump is only available from one source, Council is asked to waive the requirements of the Procurement Code and authorize this purchase

 

Issues/Analysis: This vendor is a sole source provider of this pump. The City posted on DemandStar for 7 days in compliance with Section 287.057, Florida Statutes.

                     

Financial Information: $147,160.00 from Account #438-3513-563000.

 

Special Consideration: This pump would serve as a back-up. Long lead times exist for replacement parts. Due to the increased wastewater flows, the existing pumps are being used more frequently, resulting in increased down time for maintenance and repairs. Downtime of this vital operational equipment has led to the use of emergency de-watering services by a contracted vendor (Synagro). Over the past two months alone, the USD has paid a total of $350,240.99 to Synagro for emergency de-watering.
