Summary Brief (Agreements/Contracts only)
1. Prepared by: The State of Florida Department of Transportation (“FDOT”).
2. Parties: City of Port St. Lucie Utility Systems Department (“USD”) and the State of Florida Department of Transportation.
3. Purpose: Utility infrastructure relocation to accommodate the FDOT’s construction of Southern Interchange Ramps for the Turnpike through a Utility Work by Highway Contractor Agreement (“UWHCA”).
4. New/Renewal/Modified: New.
5. Duration: N/A.
6. Benefits to Port St. Lucie: This project will build access to and from the south of Florida’s Turnpike. The two ramps to be constructed as part of this project will be the Turnpike Northbound off-ramp to Midway Road and the Midway Road Southbound on-ramp.
7. Cost to Port St. Lucie (Annual and Potential): The FDOT is responsible for all costs of the utility work and all costs associated with any adjustments or changes to the utility work.

Staff Recommendation: Move that the Council approve the resolution and authorize the City Manager to execute the Utility Highway Contractor Agreement with FDOT and any other documents related to the Project.

1. Move that the Council amend the recommendation, approve the resolution, and authorize the City Manager to execute the Utility Highway Contractor Agreement with FDOT and any other documents related to the Project.
2. Move that the Council deny the resolution and provide staff with direction.
Background: Florida’s Turnpike Enterprise, part of the Florida Department of Transportation (FDOT), is designing a new interchange at Midway Road and Florida’s Turnpike. Design is the third phase of the FDOT project development process; the utility infrastructure must be relocated in order to accommodate this Project. The FDOT and the USD desire to enter into a joint agreement pursuant to Section 337.403(1)(b), Florida Statutes for the Utility Work to be accomplished by the FDOT’s contractor as part of the construction of the Project. The FDOT, pursuant to the terms and conditions of the UWHCA, will bear certain costs associated with the Utility Work.
Issues/Analysis: N/A.
Financial Information: The FDOT is responsible for all costs of the utility work and all costs associated with any adjustments or changes to the utility work.
Special Consideration: Entering into this agreement is necessary for the FDOT to proceed with the construction of Southern Interchange Ramps for the Turnpike.
