Summary Brief (Agreements/Contracts only)

1.                     Prepared by: Michelle Fentress, Procurement Agent I, PMD.

2.                     Parties: City of Port St. Lucie and Heavy Civil, Inc.

3.                     Purpose: To account for all field adjustments incurred through January 08, 2022.

4.                     New/Renewal/Modified: Modified.

5.                     Duration: Initial contract term was April 25, 2021, through October 22, 2021.  Amendment 1 increased the initial contract time an additional 20 days; thereby, the overall contract time was increased to be 200 calendar days and/or November 11, 2021. Amendment 2 increased the contract time an additional 40 days; thereby, the contract time was increased to be 240 calendar days and/or December 21, 2021. Amendment 3 increased the contract time an additional 18 days; thereby, the contract time was increased to 258 calendar days and/or January 8, 2022. There is no additional time associated with Amendment 4.

6.                     Benefits to Port St. Lucie: To facilitate the completion of the project without impeding ongoing construction activities.

7.                     Cost to Port St. Lucie (Annual and Potential): Additional services need to be added to the contract to compensate the contractor for items not specifically identified in the original scope of work.  The following amendments need to be added to the contract; $47,163.15 for Amendment #1; $56,443.24 for Amendment #2 and $68,274.14 for Amendment #4. The inclusion of the above amendments will result in the original contract amount of $415,000.00 being increased to $518,606.39. There was no contract price increase associated with Amendment #3.

Staff Recommendation: Move that the Council approve Amendment #1 through Amendment #4 to Contract #20210025 for the Construction of the Sandia Drive Sidewalk Project with Heavy Civil, Inc.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and approve Amendment #1 through Amendment #4 to Contract #20210025.

2.                     Move that the Council not approve Amendment #1 through Amendment #4 to Contract #20210025 and provide staff with direction.

 

Background:

Amendment #1:  This amendment provides for inclusion of two (2) new pay items and increases to four (4) existing contract pay items.  It also adds an additional 20 calendar days to the contract for the additional work.

 

Amendment #2:  This amendment provides for the inclusion of twelve (12) new pay items, increases to eight (8) contract pay items and decreases to two (2) contract pay items.  It also adds an additional 40 calendar days to the contract.

 

Amendment #3:  This amendment adds an additional 18 calendar days to the contract.

 

Amendment #4:  The bulk of this amendment is for additional work associated with revising the drainage swales between Kaspar Drive and Crosspoint Drive in addition to incurred over and underruns to existing Contract pay items as needed to complete the project.  Between Kaspar and Fallon, due to the elevation difference between the proposed back of sidewalk grade and the swale grade, the front and back slopes exceeded the maximum allowable 3:1 slope.  Likewise, between Fallon Drive and the drainage easement between Fallon drive and Crosspoint Drive, a similar condition existed.  It was decided to pipe the two roadside swales and construct shallow swale on top.

 

Issues/Analysis: Per Ordinance 35.07 - Extra Services performed or deleted…”any charges in excess of $25,000.00 may be made only when authorized by the City Council.  Staff has reviewed the additional compensation and find that it is fair and reasonable for the amount of the project oversight that was completed through January 8, 2022.

                     

Financial Information: Funds are appropriated in the ½ Cent Sales Tax Fund / Road & Bridge / Improvements O/T Building (#310-4105-563000-Y1420).

Location of Project: Sandia Drive Sidewalk from Thornhill Drive to Crosspoint Drive.
