3. Purpose: Provide Construction Manager at Risk Preconstruction Services for the Westport Wastewater Treatment Facility (“WWTF”) Nutrient Reduction Improvements Project.
4. New/Renewal/Modified: New.
5. Duration: 180 calendar days for Preconstruction Services.
6. Benefits to Port St. Lucie: To provide high quality treatment to reduce nutrients discharged to the St. Lucie River in compliance with new Florida Department of Environmental Protection (“FDEP”) limits for nitrogen and phosphorous. By reducing the amount of nutrients discharged, it will reduce the growth of algae, improve the water quality, and reduce health effects of the St. Lucie River.
7. Cost to Port St. Lucie (Annual and Potential): One-time expense of $210,305.00 for the Preconstruction Phase Services.

Staff Recommendation: Move that the Council award Contract #20220044 and enter into a Contract with Wharton-Smith, Inc. for Construction Manager at Risk (“CMAR”) Preconstruction Services.
Alternate Recommendations:
1. Move that the Council not award Contract #20220044 and provide staff with direction.
Background: The Westport WWTF is currently permitted to treat 6.00 million gallons per day (“MGD”) of wastewater using biological processes to produce secondary treatment standards of 20 mg/l BOD, 20 mg/l total suspended solids, and no limits for Total Nitrogen (TN) and Phosphorus (P). The new FDEP nutrient limits require additional treatment processes to achieve limits less than or equal to 10 mg/l TN and 6 mg/l P. The City authorized an engineering firm to proceed to design improvements to meet the new effluent standards and produce the construction plans. Once the design plans were produced, the challenge was to complete the construction for the improvements within a short period of time. To meet the time frame, the Utility Systems Department decided to use the Construction Manager at Risk (CMAR) delivery method. The selection of the CMAR firm was qualifications-based in accordance with Florida Statutes for selection of Construction Management firms.
A Request for Proposals (RFP) was issued on October 26, 2022 to 1,286 potential suppliers. There were two proposals received on December 15, 2022. PMD held the first evaluation meeting on January 10, 2023 to review and discuss the proposals and individual scores. The Evaluation Committee invited both firms to the second evaluation meeting held on January 27, 2023 to make presentations and answer more detailed questions regarding the project. The Evaluation Committee reviewed the scores and adjusted accordingly. The final scores were announced as follows:

#2 Ranked Firm: PCL Constructions - 2,490 Total Points
The Evaluation Committee voted to enter into contract negotiations with the #1 ranked firm, Wharton-Smith, Inc. After negotiations, an agreement was made to accept the proposal of $210,305.00 for Preconstruction Services.
Issues/Analysis: Staff has reviewed the proposal for Preconstruction Services and finds the fees to be fair and reasonable.
Financial Information: Funds will be appropriated in Utility CIP Fund / Westport Wastewater Plant / Improvements O/T Buildings (#448-3512-56300-Y1782).
Special Consideration: As part of the Preconstruction Services, the Contractor will prepare a Guaranteed Maximum Price (GMP) and project schedule which will be placed on a future Council agenda for approval prior to commencing the Construction Phase of the project.
