Summary Brief (Agreements/Contracts only)

1.                     Prepared by: Utility Systems Department (“USD”)

2.                     Parties: City of Port St. Lucie and LTC Ranch Industrial/Commercial Park Master Property Owner’s Association, Inc., a Florida not for profit corporation (the “POA”).

3.                     Purpose: For the City to convey a Sign Maintenance Easement to the POA for the maintenance of a monument sign.

4.                     New/Renewal/Modified: New.

5.                     Duration: In perpetuity.

6.                     Benefits to Port St. Lucie: The City is separately acquiring Parcel 30, currently owned by LTC Ranch Joint Venture, for utility purposes, however, the City will construct a monument sign on Parcel 30 and the POA has agreed to maintain the monument sign.

7.                     Cost to Port St. Lucie (Annual and Potential): There is no cost for the conveyance of the easement.

Staff Recommendation: Move that the Council approve the Ordinance authorizing the Mayor or City Manager to enter into a Sign Maintenance Easement Agreement conveying a Sign Maintenance Easement to the POA. 

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and approve the Ordinance authorizing the Mayor or City Manager to enter into a Sign Maintenance Easement Agreement conveying a Sign Maintenance Easement to the POA. 

2.                     Move that the Council not approve the Ordinance authorizing the Mayor or City Manager to enter into a Sign Maintenance Easement Agreement conveying a Sign Maintenance Easement to the POA and provide staff with direction. 

 

Background: The USD installed a 30” raw water main on the subject parcel and is seeking Council approval to acquire the parcel in fee simple via Resolution 22 - R132. Once the City completes the construction of the monument sign, the POA will maintain the monument sign.

 

Issues/Analysis: This conveyance relieves the City of the obligation to maintain the monument sign at the Midway Business Park off Glades Cut-Off Road and Delcris Drive. 

                     

Financial Information: There is no cost to the City for the conveyance of this easement.

 

Special Consideration: The City will construct the monument sign on Parcel 30 pursuant to terms in a separate agreement. The Master Sign Program for the Midway Business Park allows this use. The City has agreed to modified insurance requirements in an effort to complete and close this transaction.

 

Location of Project: Delcris Drive and Glades Cut-Off Road.
