Summary Brief (Agreements/Contracts only)
1. Prepared by: Robyn Holder, CPPB (PMD).
2. Parties: City of Port St. Lucie and CHA Consulting, Inc. fka Reiss Engineering, Inc.
3. Purpose: To provide high quality wastewater treatment by reducing the nutrients discharged to the St. Lucie River and to be in compliance with new FDEP limits for nitrogen and phosphorus.
4. New/Renewal/Modified: Modified.
5. Duration: The initial term began on 3/13/2018 through 3/13/2023. Through several Amendments the time has been extended through 6/13/2026. Amendment #9 extended the time through 8/27/2026 and Amendment #10 further extends the time through 10/11/2026.
6. Benefits to Port St. Lucie: By reducing the amount of nutrients discharged, it will reduce the growth of algae, improve the water quality, and reduce health effects of the St. Lucie River.
7. Cost to Port St. Lucie (Annual and Potential): Amendment #9 added an additional $31,134.88 and Amendment #10 will add an additional $122,102.50. The new Contract total after Amendment #10 would be $6,847,438.85.

Staff Recommendation: Move that the Council Ratify the Signature of the Office of Management & Budget and Procurement Director for Amendment #9 & Approve Amendment #10 to Contract #20170132 for the Design Services of the Westport Wastewater Treatment Facility Nutrient Reduction Improvement Project.
Alternate Recommendations:
1. Move that the Council amend the recommendation and Ratify the Signature of the Office of Management & Budget and Procurement Director for Amendment #9 & Approve Amendment #10 to Contract #20170132 for the Design Services of the Westport Wastewater Treatment Facility Nutrient Reduction Improvement Project.
2. Move that the Council not Ratify Amendment #9 or Approve Amendment #10 to Contract #20170132 and provide staff with direction.
Background: The Westport Wastewater Treatment Facility is currently permitted to treat 6.0 MGD of wastewater using biological processes to produce secondary treatment standards of 20 mg/l BOD, 20 mg/ total suspended solids, and no limits for Total Nitrogen (TN) and Phosphorus (P). The new Florida Department of Environmental Protection (“FDEP”) nutrient limits require additional treatment processes to achieve limits less than or equal to 10 mg/l TN and 3 mg/l P. The City authorized an engineering firm, CHA Consulting, Inc., to proceed to design improvements to meet the new effluent standards and produce the construction plans. The design engineering firm has completed the design to achieve those treatment standards. Additional treatment facilities for Advanced Wastewater Treatment are necessary to meet FDEP nutrient requirements and are achieved by including Reject Water Storage Tanks. The design engineering firm will have to submit the permit application to FDEP for construction of these storage tanks which will require a Wetland mitigation report and documents.
Amendment #9 included design services for the air control valves motor actuator additions and modifications to the water quality analyzer communication system.
Amendment #10 includes design and construction of two new reject water storage facilities for out-of-specification effluent (reject water) which will be a separate bid package from Part 2A and 2C.
Issues/Analysis: Staff has reviewed the Amendments and recommends that the City proceed with the improvements currently underway at the Westport Wastewater Treatment Facility to comply with FDEP nutrient standards and to produce a high-quality wastewater effluent that will improve the water quality of the St. Lucie River.
Financial Information: Funds are appropriated in the Utility CIP Fund / Westport WWTP / Design / WP Expansion (448-3512-563004-Y1728).
