Summary Brief (Agreements/Contracts only)

3.                     Purpose: St. Lucie County has begun using CivicPlus, LLC’s publicly accessible website for its legally required advertisement and public notices and the City may use the website as well for its legally required advertisements and public notices                     

4.                     New/Renewal/Modified: New

5.                     Duration: One (1) year

6.                     Benefits to Port St. Lucie: The City spends approximately $30,000 per year, inclusive of all departments, on legally required advertisements and public notice. Transitioning to CivicPlus will save the City upwards of $20,000 per year on legally required advertisement and public notice costs.

7.                     Cost to Port St. Lucie (Annual and Potential): $9,000 per year

Staff Recommendation: Move that the Council approve the Participation Agreement for use of CivicPlus, LLC’s publicly accessible website between St. Lucie County and the City of Port St. Lucie and approve the Governmental Agency Order/Publicly Accessible Website Agreement between CivicPlus, LLC and the City of Port St. Lucie.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and approve the Participation Agreement for use of CivicPlus, LLC’s publicly accessible website between St. Lucie County and the City of Port St. Lucie and approve the Governmental Agency Order/Publicly Accessible Website Agreement between CivicPlus, LLC and the City of Port St. Lucie.

2.                     Move that the Council not approve either agreement and provide staff with direction.

 

Background: Pursuant to Section 50.0311, Florida Statutes, if a county uses a publicly accessible website to publish its legally required advertisements and public notices, a governmental agency may also use that same publicly accessible website for legally required advertisements and public notices.   

 

St. Lucie County has decided to contract with CivicPlus, LLC (“CivicPlus”) for publication of public notices and legally required advertisements. The Clerk’s Office has communicated with CivicPlus and it is the recommendation of staff to use CivicPlus’ website for the City’s legally required advertisement and public notices, as opposed to publishing in a local newspaper. 

 

Issues/Analysis: A resident may request, in writing, to receive legally required advertisements and public notices from the City by first-class mail or e-mail and the City shall maintain a registry of all such names, addresses, and email addresses of such residents.

 

Once per year, the City must publish in a newspaper of general circulation or another publication that is mailed and delivered to all residents and property owners, a notice which indicates the use of the publicly accessible website and the option for residents to request the legally required advertisements or public notices via first-class mail or e-mail.
